Tony Smith v. CDHA Dismissed

The chair of an independent human rights board of inquiry has dismissed the complaint by Tony Smith against Capital District Health Authority.

In his decision, board chair Donald Murray states that decisions by the health authority to move Mr. Smith's job to a new hub-style location was not related to his race and/or colour, or rooted in retaliation for previous complaints filed against his employer.

"I have not heard any evidence which suggests, let alone proves on a balance of probabilities, that moving Mr. Smith's job functions to the Sackville hub was in any way based on Mr. Smith's race or colour — or was related in any way to the fact that he had made a human rights complaint against his employer in 1994," said Mr. Murray.
