This Indenture made the Day of in the year of Our Lord one thousand eight hundred and fifteen, between John Gardiner Herbert Esq. Captain in His Majestys 10th Royal Veteran Battalion, and Emily his wife of the one part, and John Liddell, Charles Boggs and John Wenman Pyke of Halifax in the Province of Nova Scotia, Merchants, of the other part, Witnesseth that the Said John Gardiner Herbert and Emily, his wife for and in consideration of the sum of twenty pounds of lawful money of Nova Scotia in hand paid at or before the sealing and delivery of these presents by the Said John Liddell, Charles Boggs and John Wenman Pyke, the receipt and payment whereof is hereby acknowledged, have granted, bargained, Sold, enfeoffed and Confirmed and by these presents do grant, bargain, sell, enfeoff and confirm unto the said John Liddell, Charles Boggs and John Wenman Pyke their heirs and assigns All that piece and parcel of Land situate, Lying and being on the Northern Side of Hammond Plain Grant in the County of Halifax and Province aforesaid, described Lot No. 3, Containing five hundred acres bounded Northerly by Charles Boggs Southerly by James Ewing, Westerly by Christian Greene and easterly by Adam Beswanger's Lands, together with all the buildings and improvements thereon and thereunto belonging and the reversion and reversions remainder and remainders rents issues and profits of all and singular the said piece of Land and premises and every part thereof, and also all the estate, right, title, intent, claim property and demand of them the Said John Gardiner Herbert and Emily his wife in to or out of the Said piece of Land and premises and every part thereof To have and To Hold the Said piece of Land and premises with the appurtenances unto the Said John Liddell, Charles Boggs and John Wenman Pyke their heirs and assigns to the only use and behoofs of the Said John Liddell, Charles Boggs and John Wenman Pyke their heirs and afsigns forever -- And the said John Gardiner Herbert for himself his heirs, executors and administrators doth hereby Covenant promise and grant to and with the said John Liddell, Charles Boggs and John Wenman Pyke their heirs and afsigns that he the said John Gardiner Herbert at the time of the sealing and delivery of these presents is and stands seized in his own right of a good perfect sure and indefeasible Estate of inheritance in fee simple of in and to the said piece of Land and premises and every part thereof, and that he the Said John Gardiner Herbert has good right full power and lawful authority to grant Sell and Convey the Said piece of Land and premises unto the Said John Liddell, Charles Boggs and John Wenman Pyke their heirs and assigns to their proper use and benefit for ever according to the true intent and meaning of these presents, And further that he the Said John Gardiner Herbert the Said piece of Land and premises unto the Said John Liddell, Charles Boggs and John Wenman Pyke their heirs and afsigns shall and will Warrant and for ever defend by these presents. In witness whereof the parties to these presents have hereunto set their Hand and Seals the day and year first above written.
