Fox Point Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 79-654 (June 5, 1979), N.S. Reg. 83/79


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 28th day of May, A.D., 1979, pursuant to Section 5(1) of Chapter 6 of the Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act, is pleased to designate as a beach an area of land lying landward from the mean high watermark of Fox Point Beach, in the County of Cumberland, Province of Nova Scotia, as shown outlined in red on the copy of Crown Land Records Office Plan No. E-11-21 marked Schedule “B”, and described in Schedule “A” both attached to and forming part of the report and recommendation.



Schedule “A”


All those certain lots, pieces or parcels of land lying landward from the mean high watermark of Fox Point Beach, in the County of Cumberland, Province of Nova Scotia shown outlined in red as Parcel “A” and Parcel “B” on the copy of Crown Land Records Office Plan No. E-11-21 signed by D.L. Crooker, Nova Scotia Land Surveyor on the 22nd day of September, A.D. 1978, said plan being attached hereto and also being more particularly described as follows:


Lot “A”


Beginning at Crown Land Iron Post No. C1892 being situate (by grid azimuths referred to the Nova Scotia 3° Transverse Mercator Projection, Zone 5, central meridian 64° 30' west longitude) 143° 29' 48", a distance of 6,075.41 feet from Nova Scotia Control Monument No. 15124;


From Thence 36° 17' 12", a distance of 100.00 feet to a point marked “M” on the attached plan;


Thence 106° 16' 44", a distance of 455.06 feet to a point marked “N” on the attached plan, said point being situate on the westerly boundary of an access road to the beach;


Thence 124° 12' 50", a distance of 708.41 feet to a point marked “P” on the attached plan;


Thence 65° 48' 12", a distance of 537.07 feet to a point marked “Q” on the attached plan;


Thence 126° 17' 12", a distance of 400.00 feet to a point marked “O" on the attached plan;


Thence 216° 17' 12", a distance of 50.00 feet to Crown Land Iron Post No. C1891 situate on the edge of the upland vegetation;


Thence 208° 36' 32", a distance of 225.00 feet, more or less, to a point situate on the edge of a brook running into Greville Harbour;


Thence in a generally westerly direction along the edge of the aforesaid brook and the mean high watermark of Fox Point Beach 2450 feet, more or less, to a point;


Thence 36° 17' 12", a distance of 50 feet, more or less, to the place of beginning.

 

 

Lot “B”


Beginning at a point situate on the mean high watermark of Greville Bay, being 126° 17' 11", a distance of 1,844.34 feet from Crown Land Iron Post No. C1892;


From Thence continuing 126° 17' 11", a distance of 50 feet, more or less, to Crown Land Iron Post No. C1890;


Thence 28° 36' 32", a distance of 435 feet, more or less, to a point situate on the southerly bank of a brook running into Greville Bay;


Thence in a westerly and southerly direction along the shore of the brook and the mean high watermark of Greville Bay 870 feet, more or less, to the place of beginning.
