Licensing and Furnishing of Information Regulations

made under Section 8 of the
Primary Forest Products Marketing Act
R.S.N.S. 1989, c. 355

1 In these regulations

(a) "Board" means the Nova Scotia Primary Forest Products Marketing Board;

(b) "pulpwood chips" means wood chips, including sawmill chips, intended for processing into wood pulp, paper, or any manufactured products.

2 Any person appointed by the Board and authorized in writing by the Minister of Natural Resources may enter at any reasonable time the business premises of a person or persons engaged in the marketing of primary forest products, or the premises of such person or persons where the records are kept to examine his business records respecting the marketing of primary forest products to determine whether the Primary Forest Products Marketing Act and regulations made thereunder are being or have been complied with and to inspect, audit and examine books of account, records and other such documents respecting the marketing of primary forest products, and the person engaged in the marketing of primary forest products and the person occupying such premises shall answer all questions pertaining to these matters and shall produce such books of account, records or documents as may be required.

3 If a buyer buys pulpwood or pulpwood chips in Nova Scotia for processing in his mill in Nova Scotia, the buyer shall keep in respect to said pulpwood or pulpwood chips a record of

(i) the number of cords, metric tonnes, or equivalent,

(ii) the name and mailing address of the pulpwood or pulpwood chip seller, and

(iii) any amount withheld from each pulpwood or pulpwood chip seller as a result of charges imposed by the Board pursuant to Section 10 of the Act

and shall remit to the Board monthly the information kept by him during the previous month.

4 If a buyer buys pulpwood or pulpwood chips in Nova Scotia for shipment out of Nova Scotia, the buyer shall keep in respect to said pulpwood or pulpwood chips a record of

(i) the number of cords, metric tonnes, or equivalent,

(ii) the name and mailing address of the pulpwood or pulpwood chip seller, and

(iii) any amount withheld from each pulpwood or pulpwood chip seller as a result of charges imposed by the Board pursuant to Section 10 of the Act

and shall remit to the Board monthly the information kept by him during the previous month.

5 If a person engaged in the business of processing pulpwood or pulpwood chips in Nova Scotia places at or near his mill for processing in said mill pulpwood or pulpwood chips which that person has cut from woodlands which he owns or on which he has cutting rights in Nova Scotia, or pulpwood chips acquired from a sawmill operation which he owns in Nova Scotia, the person shall keep in respect to the pulpwood or pulpwood chips a record of

(a) the number of cords, metric tonnes or equivalent cut from his own land;

(b) the number of cords, metric tonnes or equivalent cut from land on which he has cutting rights;

(c) the number of cords, metric tonnes or equivalent cut from Crown land;

(d) the number of cords, metric tonnes or equivalent from his own sawmill; and

(d)[e] any amount payable to the Board as a result of charges imposed by the Board pursuant to Section 10 of the Act

and shall remit to the Board monthly the information kept by him during the previous month.

6 If a person engaged in the business of processing pulpwood or pulpwood chips in his mill outside Nova Scotia assembles or has assembled for him in Nova Scotia for shipment to such mill, pulpwood or pulpwood chips from woodlands in Nova Scotia which he owns or on which he has cutting rights, or pulpwood chips acquired from a sawmill operation which he owns in Nova Scotia, the person shall keep in respect to the pulpwood or pulpwood chips a record of

(i) the number of cords, metric tonnes, or equivalent, and

(ii) any amount payable to the Board as a result of charges imposed by the Board pursuant to Section 10 of the Act

and shall remit to the Board monthly the information kept by him during the previous month.

7 The regulations made by the Pulpwood Marketing Board on the 11th day of June, 1976 and approved by Order in Council 76-738 on the 22nd day of June, 1976 as amended by the Board and approved by Orders in Council 80-592, 81-1290 and 83-371 are hereby repealed as and from the 1st day of January, 1989.

8 These regulations are made by the Nova Scotia Primary Forest Products Marketing Board pursuant to Section 5 of the Primary Forest Products Marketing Act, Statutes of Nova Scotia 1972, Chapter 15, as amended, [Section 8, R.S.N.S. 1989, c. 355] and shall be in force on and from the 1st day of January, 1989.
