Port Maitland Provincial Park Designation

made under Section 8 of the

Provincial Parks Act

R.S.N.S. 1989, c. 367

O.I.C. 76-841 (July 13, 1976), N.S. Reg. 161/76


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 24th day of June, A.D., 1976, and pursuant to Section 2 of Chapter 244 of the Revised Statutes of Nova Scotia, 1967, the Provincial Parks Act, is pleased to

 

       (a)    constitute all that area of land including land covered with water owned by Her Majesty in right of the Province of Nova Scotia, situate at or near Port Maitland Beach, in the County of Yarmouth, Province of Nova Scotia, to be a Provincial Park, said area of land being described in Schedule “A” and shown on Schedule “B”, both attached to and forming part of the report and recommendation; and

 

       (b)    declare that the park shall be known as “Port Maitland Beach Provincial Park”.

“Port Maitland Beach Provincial Park”


All that certain parcel, piece or lot of land situated, lying and being at or near Port Maitland, County of Yarmouth, Province of Nova Scotia, the said parcel, piece or lot of land being and intending to be “Port Maitland Beach Provincial Park”, as shown on Plan E-5-66, recorded at the Crown Lands Registry Office, Department of Lands and Forests, Halifax, and being more particularly described as follows:


Beginning at Crown Land Iron Post (C.L.I.P.) No. Y263 set at the intersection of the northeastern boundary line of the Shore Road, so-called, leading from Highway No. 1 to the Port Maitland Wharf and the northwestern boundary line of Beach Street;


From thence by magnetic (1974) bearings N 44° 28' E along a fence line set on the southeastern boundary line of land now or formerly of Donald Moses, distance 500.48 feet (being calculated) more or less to C.L.I.P. No. Y264;


Thence N 41° 16' W along a fence line set on the northeastern boundary line of the said Donald Moses lands, distance 164.78 feet more or less to C.L.I.P. No. Y265;


Thence continuing N 41° 16' W along the northeastern boundary line of lands now or formerly of Ivan E. Thomas, distance 164.00 feet more or less to C.L.I.P. No. Y266;


Thence continuing on a prolongation, distance 20 feet more or less to the mean high water mark of Port Maitland Beach;


Thence in a northeasterly direction along the many courses of the mean high water mark of the said Port Maitland Beach, distance 1175 feet more or less to the intersection of the southwestern boundary line of Spieder Road and the said mean high water mark;


Thence in a southeasterly direction along the southwestern boundary line of the said Spieder Road, distance 40 feet more or less to a Crown Land Wooden Post (C.L.W.P.), the said C.L.W.P. being at the end of a traverse line N 36° 31' E, distance 742.39 feet and N 28° 11' E, distance 417.96 feet more or less from C.L.I.P. No. Y266;


Thence S 40° 56' E along the southwestern boundary line of the said Spieder Road, distance 173.34 feet more or less to a C.L.W.P. set at the northwesterly corner of lands now or formerly of Donald Moses;


Thence S 26° 27' W along the northwestern boundary line of the said Donald Moses lands, distance 426.16 feet more or less to C.L.I.P. No. Y295;


Thence S 40° 05' E, along a fence line set on the southwestern boundary line of the said Donald Moses lands, distance 593.13 feet (being calculated) more or less to C.L.I.P. No. Y296;


Thence S 35° 31' W, along the northwestern boundary line of lands now or formerly owned by Lloyd Moses, distance 429.15 feet more or less to C.L.I.P. No. Y271;


Thence S 35° 31' W, along a fence line set on the northwestern boundary line of lands now or formerly of Fred Delaney, distance 306.59 feet more or less to C.L.I.P. No. Y272;


Thence N 40° 53' W, along the northeastern boundary line of lands now or formerly of Ashton Thomas, distance 51.75 feet more or less to C.L.I.P. No. Y273;


Thence S 44° 27' W, along the northwestern boundary line of the said Ashton Thomas lands distance 175.14 feet more or less to C.L.I.P. No. Y274;


Thence N 40° 50' W, along the northeastern boundary line of lands now or formerly of Burton Outhouse, distance 363.69 feet more or less to C.L.I.P. No. Y275 set on the southeastern boundary line of the said Beach Street;


Thence S 44° 12' W, along the southeastern boundary line of the said Beach Street, distance 322.95 feet more or less to C.L.I.P. No. Y276 set at the intersection of the northeastern boundary line of the said Shore Road and the southeastern boundary line of the said Beach Street;


Thence N 39° 44' W, distance 49.57 feet more or less to the point of beginning.


The said parcel, piece or lot of land containing by admeasurement 17 acres more or less.
