Pearl Island Wildlife Management Area Designation and Regulations

made under Section 113 of the
Wildlife Act
R.S.N.S. 1989, c. 504
O.I.C. 76-1279 (November 2, 1976, effective November 1, 1976), N.S. Reg. 99/76

The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 28th day of October, A. D., 1976, pursuant to clause (a) of subsection (6) of Section 161 of Chapter 163 of the Revised Statutes of Nova Scotia, 1967, the Lands and Forests Act, is pleased to:

(a) declare that the area described in Schedule "A" and shown outlined in red on Schedule "B", both attached to the report and recommendation, be a Wildlife Management Area to be known as the Pearl Island Wildlife Management Area;

(b) make regulations in the form set out in Schedule "C" attached to the report and recommendation, for the control of the Wildlife Management Area and the management of the wildlife therein.


Schedule "A" - Description of Pearl Island Wildlife Management Area

Beginning at a point south of Pearl Island in Mahone Bay, Nova Scotia, said point being a distance of one half statute mile seaward from the mean high water mark of the south shore of said Pearl Island and on a true bearing of South from Geodetic Survey Station Pearl Island Light House having Geographic Co-ordinates of 44° 22' 57" .98 North and 64° 02' 56" .36 West;

Thence from said place of beginning, Westerly, Northerly, Easterly, Southerly and Westerly to the place of beginning, being at all points a distance of one half statute mile seaward from the nearest point of the mean high water mark on the shore of said Pearl Island, including Pearl Island the water and protruding rocks up to one half mile distant seaward from the mean high water mark of said Pearl Island. The area designated as Pearl Island Wildlife Management Area is shown enclosed by a red line on the annexed plan.

Regulations made pursuant to Section 113 of the Wildlife Act
Respecting the Control and Management of the Pearl Island Wildlife Management Area

1 In these regulations,

(a) "Act" means the Wildlife Act;

(b) "Minister" means the Minister of Natural Resources;

(c) "Department" means the Department of Natural Resources;

(d) notwithstanding clause (n) of Section 84 of the Act a "warden" includes any person appointed by the Minister for the preservation and maintenance of the public peace and enforcement of the statutes coming under the jurisdiction of the Department;

(e) "firearm" means any bow or barrelled weapon from which any shot, bullet or other missile that is capable of causing serious injury or death can be discharged and includes anything that can readily be adapted for use as a firearm;

(f) "Management Area" means the Pearl Island Wildlife Management Area.

2 Except as provided in these regulations, no person shall

(a) kill, take, hunt or pursue or attempt to kill or take any wild mammal or bird; or

(b) have in his possession any firearm, trap, snare, or poison or any wild mammal or bird or the carcass or any part of any wild mammal or bird within the limits of the Management Area.

3 (1) No person shall enter or be within the Management Area during the period April 1 to August 15 of any year.

(2) Notwithstanding subsection (1) any person may enter and be within the limits of the Management Area

(a) if the person is a bona fide commercial fishermen retrieving lobster traps or other materials essential to his business operations; or

(b) if the person is in possession of written permission of the Minister or his agent.

4 Subject to Section 3, the hunting of wildlife in the Management Area is permitted during the open season as determined by Provincial and Federal statutes.

5 The Minister may specify the terms and conditions upon which any permit is issued.

6 Where the Minister proposes to permit limited hunting within the Management Area, he shall give public notice thereof in at least one edition of a newspaper having general circulation in the Province.

7 The Minister may specify the number of persons that will be permitted to enter the Management Area on any one day for the purpose of hunting.

8 Every person authorized by the Minister or his agent to enter the Management Area shall

(a) follow all instructions issued by the Minister or his agent with respect to his activities within the Management Area;

(b) subject to these regulations, comply with the provisions of Provincial and Federal statutes pertaining thereto, and any regulations made thereunder;

(c) file a report as required by the Minister or warden; and

(d) turn over to a warden any part of the carcass of any wild mammal or bird killed or taken within the Management Area.

9 No person shall, within the Management Area, destroy, disturb or molest in any way the habitat or nesting sites of any mammals or birds found therein.

10 Any bag limit specified by the Wildlife Act, Acts of the Parliament of Canada pertaining thereto, and any regulations made thereunder shall include any mammal or bird taken within the Management Area during the open season for such mammals or birds as determined by statute.

11 Any person convicted of a violation of any of the provisions of these regulations shall incur a penalty of not less than one hundred dollars nor more than five hundred dollars.

12 These regulations shall come into force on the 1st day of November, 1976.
