The Residential Tenancies Act (the RTA) sets out guidelines for the relationship between landlords and tenants. It also provides an efficient and cost-effective means of settling disputes. Not all residential housing is included in the Act. University and college residences on campuses, hospitals, municipal homes, prisons, reformatories, some nursing homes, and hotels are not governed by the Act.
Generally, only rented housing falls under the RTA. However, lease-to-purchase arrangements do fall under the Act until the tenant owns the premises. It is a good idea to make the purchase and sale agreement and lease two separate, signed agreements.
