Dominion Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 76-843 (July 13, 1976), N.S. Reg. 134/76


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 29th day of June, A.D., 1976, and pursuant to Section 5(1) of Chapter 6 of the Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act, is pleased to designate as a beach an area of land lying landward from the mean high watermark of Dominion Beach, in the County of Cape Breton, Province of Nova Scotia, as shown outlined in red on the copy of Crown Land Records Office Plan No. E-5-57 marked Schedule “B” and described in Schedule “A”, both attached to and forming part of the report and recommendation.



Schedule “A”


All that certain area of land lying landward from the mean high watermark of Dominion Beach, in the County of Cape Breton, Province of Nova Scotia as shown outlined in red on a copy of Plan No. E-5-57 attached hereto, filed in the Crown Land Records Office, Halifax, and being more particularly described as follows:


Beginning at a concrete post situated at the northeasterly corner of the bridge at Dominion; said post having co-ordinate values (N 16, 798, 062.72, E 1, 371, 862.23) based on the Nova Scotia Three Degree Transverse Mercator Projection, Zone 4, Central Meridian 61° 30' west longitude;


From thence (by astronomic bearings referenced to meridian 61° 30' W) north forty-seven degrees thirty-four minutes fourteen seconds east seven hundred fourteen decimal sixty-eight feet to an iron post having co-ordinate values (N 16, 798, 544.90, E 1, 372, 389.74);


Thence north twenty-nine degrees five minutes thirty-seven seconds west six thousand four hundred feet to point “B” as shown on said plan and having co-ordinate values (N 16, 304, 137.39, E 1, 369, 277.82);


Thence south seventy degrees fifty-four minutes twenty-three seconds west four thousand feet to point “C” as shown on said plan and having co-ordinate values (N 16, 802, 828.94, E 1, 365, 497.88);


Thence south nineteen degrees five minutes thirty-seven seconds east four thousand feet to point “D” as shown on said plan and having co-ordinate values (N 16, 799, 049.00, E 1, 366, 806.00);


Thence north eighty-three degrees twenty minutes nine seconds east, three thousand five hundred and eight decimal fifty-two feet to point “A” as shown on said plan and having co-ordinate values (N 16, 799, 456.16, E 1, 370, 291.14);

 

Thence south forty-eight degrees twenty-five minutes forty-six seconds east two thousand one hundred feet to the place of beginning.


Excepting and reserving from the above described area of land all the portion thereof lying seaward from the mean high watermark.
