Fox Island Main Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 76-26 (January 13, 1976), N.S. Reg. 131/76


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 7th day of January, A.D., 1976, pursuant to subsection (1) of Section 5 of Chapter 6 of the Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act, is pleased to designate as a beach an area of land lying landward from the mean high watermark of Fox Island Main Beach, in the County of Guysborough, Province of Nova Scotia, as shown outlined in red on the copy of Crown Land Records Office Plan No. E-5-51 and described in Schedule “A”, both attached to and forming part of the report and recommendation.


All that certain area of land lying landward from the mean high watermark of Fox Island Main Beach, in the County of Guysborough, Province of Nova Scotia as shown outlined in red on a copy of Plan No. E-5-51 filed in the Crown Land Records Office, Halifax and being more particularly described as follows:


Beginning at an iron post (designated on the said plan as I.P. 8443) on the southeastern boundary of lands of the Municipality of Guysborough and being distant approximately 62 feet from the mean high watermark on the southern shore line of Chedabucto Bay;


Thence N 15° 00' W, a distance of approximately 62 feet to the mean high watermark on the southern shore line of Chedabucto Bay, designated on the said plan as “A”;


Thence westerly following the said mean high water mark a distance of approximately 10,850 feet to a point, designated on the said plan as “B” and being distant approximately 20 feet on a bearing N 70° 50' E, from an iron post on the northeastern boundary of lands of Catherine B. Dewar;


Thence S 70° 50' W, a distance of approximately 20 feet to an iron post on the northeastern boundary of lands of Catherine B. Dewar;


Thence S 06° 55' E along the said Dewar boundary, a distance of 68.7 feet;


Thence S 40° 05' W along the southeastern boundary of lands of Catherine B. Dewar, a distance of 49.3 feet to a concrete post;


Thence southeasterly and northeasterly following the northern boundary of a portion of a driveway and Highway No. 16, a distance of approximately 1,200 feet;


Thence N 39° 02' W, a distance of approximately 75 feet to an iron post, being distant 829.2 feet on a bearing N 70° 50' E from the last mentioned iron post;


Thence N 01° 22' W, a distance of 80.48 feet;


Thence N 22° 00' E, a distance of 177.84 feet;


Thence N 43° 16' E, a distance of 214.46 feet;


Thence N 49° 48' E, a distance of 204.64 feet;


Thence S 85° 06' E, a distance of 205.00 feet to an iron post;


Thence N 63° 11' E, a distance of 159.78 feet to an iron post;


Thence N 19° 33' E, a distance of 142.43 feet to an iron post;


Thence N 65° 33' E, a distance of 583.98 feet to an iron post;


Thence N 68° 47' E, a distance of 450.52 feet to an iron post;


Thence N 89° 25' E, a distance of 415.79 feet to an iron post;


Thence S 73° 55' E, a distance of 827.72 feet to an iron post;


Thence N 89° 12' E, a distance of 518.55 feet to an iron post;


Thence N 66° 01' E, a distance of 565.49 feet to an iron post;


Thence N 76° 50' E, a distance of 501.81 feet;


Thence N 86° 04' E, a distance of 972.52 feet;


Thence N 77° 02' E, a distance of 498.55 feet to an iron post;


Thence N 64° 50' E, a distance of 707.58 feet to an iron post;


Thence N 86° 01' E, a distance of 1,019.48 feet;


Thence N 75° 33' E, a distance of 1,602.90 feet to the place of beginning.


Saving and excepting out a portion of Highway No. 16 which cuts through the southeastern portion of the above described land.


All of the above mentioned bearings are referred to astronomic north.
