Hibernia Wildlife Management Area Designation and Regulations made under Section 113 of the
Wildlife Act

The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 21st day of August, A.D., 1975, and pursuant to Section 161 of Chapter 163 of the Revised Statutes of Nova Scotia, 1967, the Lands and Forests Act, is pleased to declare that the land situate at Hibernia near Caledonia in the County of Queens and described in Schedule A, attached to and forming part of the report and recommendation, be a Wildlife Management Area to be known as the Hibernia Wildlife Management Area and to make regulations in the form attached to and forming part of the report and recommendation.
Schedule "A" All that certain lot piece and parcel of land situate at Hibernia near Caledonia in said Queens County, bounded and described as follows:
Beginning at a rock marked H.C. on the Northern Shore of the Second Christopher Lake;
Thence running North Twenty-five degrees, East nine chains and sixty links to a red pine;
Thence South sixty-five degrees East fourteen chains to a rock marked H.C. at the western side of the public highway;
Thence North westerly along said highway two chains and six links;
Thence North sixty-five degrees West two chains and seventy-five links;
Thence North thirteen degrees West twenty chains to a stake and stones;
Thence south sixty-five degrees East five chains;
Thence crossing the old Hibernia Road North seven chains and fifty links;
Thence East seventy-nine chains;
Thence South twelve degrees East nine chains;
Thence South seventy-seven degrees fifty minutes West eighteen chains and twenty-five links;
Thence South twelve degrees forty minutes East twelve chains and twenty-five links to the shore of the First Christopher Lake;
Thence turning to the right and following the various courses of the shore of the Lake westwardly and southwardly to a stake and stones on the west margin of said First Christopher Lake;
Thence South fifty-three degrees west seven chains and ninety links;
Thence crossing the public highway North sixty-five degrees West six chains to the Eastern margin of the Second Christopher Lake;
Thence by the margin of the said last mentioned Lake in Northwardly and Westwardly direction to the beginning or first mentioned bound.
Also a lot of land containing one hundred acres situate, lying and being in the County of Queens and bounded as follows:
Beginning at the Northwest angle of one hundred acres granted to Owen Martin in the District of Brookfield;
Thence running North thirteen chains;
Thence east seventy-five chains;
Thence South twelve degrees five minutes East thirteen chains and twenty-five links;
Thence West seventy-nine chains to the place of beginning;
Also a lot of land containing fifty acres situate, lying and being in the County of Queens and bounded as follows:
Beginning on the northern line of lands granted to Nathaniel Verge at its intersection with the western line of lands granted to Silvanus Morton;
Thence running North sixty-four degrees thirty minutes West six chains and fifty links;
Thence East thirty-six chains and fifty links;
Thence South ten chains;
Thence West thirty chains and fifty links;
Thence South twenty-three chains to the place of beginning. The above described lot being in the District of Hibernia.
Said land having been conveyed by Melvin Chute and Annie Chute, his wife, to the Nova Scotia Land Settlement Board by Deed dated June 27th, 1934, and recorded in the Registry of Deeds at Liverpool, Nova Scotia, in Book No. 70, pages 578-579; and later conveyed by the Nova Scotia Land Settlement Board to Lois L. Chute by deed dated the 24th day of July, A.D., 1944, and recorded in the Registry of Deeds at Liverpool, Nova Scotia, in Book 80, page 269, and being a portion of the lands conveyed by the Director, the Veterans’ Land Act to Richard Joseph Hurshman by Deed dated the 20th day of June, 1957, and recorded in the Registry of Deeds Office at Liverpool, Nova Scotia, in Book 92, pages 572-573.
Saving and excepting:
All that certain lot, piece and parcel of land situate, lying and being in the District of Hibernia in the County of Queens in the Province of Nova Scotia, being a portion of the fourth parcel of land as described in a conveyance from Lois Chute and Bernard Chute to the Director, the Veterans’ Land Act, by Deed dated the fourth day of October, A.D., 1946, registered in Liverpool in Book 80, pages 483-484 as No. 3446, more particularly described as follows:
Beginning at a wooded stake located 410 feet in a North-easterly direction from the Northeast corner of the barn on premises occupied by Richard J. Hurshman and from thence running in a northerly direction a distance of 120 feet to a stake;
Thence in an easterly direction a distance of 80 feet to a stake on the North side of a large oak tree on the shore of First Christopher Lake;
Thence following the several courses of the Lake shore in a Southerly and Southwesterly direction to a stake distant 50 feet perpendicularly from the point of beginning;
Thence in a westerly direction a distance of 50 feet to the place of beginning, together with a right-of-way over the land from the Highway leading from Caledonia to South Brookfield over the land and premises conveyed by Lois Chute and Bernard Chute to the Director, the Veterans’ Land Act, and occupied by Richard Joseph Hurshman as purchaser under an Agreement bearing date the fourth day of November A.D., 1946, which right-of-way will be confined to the farm hauling road through the barnyard and along the pasture fence to the premises particularly described herein, being the lands and premises conveyed by the Director, the Veterans’ Land Act to Edward D. Dickie by Indenture, dated the 31st day of October, A.D., 1951, and recorded the 16th day of November, A.D., 1954, in the Office of the Registrar of Deeds at Liverpool in Book 89, page 337.
Regulations for the Management of the Hibernia Wildlife Management Area
made pursuant to Section 113 of the Wildlife Act1 Except as provided in these regulations, no person shall
(a) kill, take, hunt, trap, or pursue or attempt to kill, take, or trap any wild animal or bird; or
(b) have in his possession any firearm, trap, snare or poison or any wild animal or bird or the carcass or any part of any wild animal or bird within the limits of the Hibernia Wildlife Management Area.
2 The killing, taking, hunting, trapping or pursuing or attempting to kill, take, or trap any beaver, muskrat, mink, otter, lynx, bobcat, fox, raccoon, weasel, fisher, marten, cougar, snowshoe hare, skunk, porcupine, or any other animal valuable for its fur within the limits of the Hibernia Wildlife Management Area is prohibited.
3 (1) Subject to Section 2, the killing, taking, hunting or pursuing with intent to hunt, take, or kill is permitted for wild animals or birds during the open season for such wild animals or birds as provided for by the Wildlife Act and the regulations made thereunder.
(2) Any bag limit specified by the Wildlife Act or any regulation made thereunder shall include any wild animal or bird taken within the limits of the Wildlife Management Area.
(3) For the purposes of this Section the possession of a firearm or the carcass or any part of a wild animal or bird is permitted subject to the provisions of the Wildlife Act and the regulations made thereunder.
4 These regulations shall come into force on the 1st day of September, 1975.
