Nova Scotia Potato Marketing Levy Regulations made under Section 11 of the
Natural Products Act

N.S. Reg. 162/82 (May 31, 1982)
as amended by N.S. Reg. 121/95 (January 17, 1995)1 These regulations may be cited as the Nova Scotia Potato Marketing Levy Regulations.
2 These regulations shall come into force on the 1st day of May, 1982.
3 In these regulations
(a) "Commodity Board" means the Nova Scotia Potato Marketing Board;
(b) "producer" means any person engaged in the production of potatoes in Nova Scotia;
(c) "packer" means any person who grades, packs, offers for sale, or processes potatoes for the purpose of marketing and includes a producer packer;
(d) "producer-packer" means a producer who is a packer in respect of all or any portion of potatoes produced by him;
(e) "marketing" includes advertising, buying, selling, storing, packing, assembling, shipping, transporting, pricing, processing, shipping for sale or storage, reselling or any other act necessary to prepare potatoes in a form or to make potatoes available at a place and time for purchase for consumption or use;
(f) "hundred weight" shall mean one hundred pounds Imperial Measure.
4 Every producer who produces 2 acres or more of potatoes shall register with the Commodity Board each year and provide the information in the form required by the Board.
Section 4 replaced: N.S. Reg. 121/95.5 Every producer shall pay to the Commodity Board a levy established by the Commodity Board, from time to time, on each hundred weight of potatoes marketed by the producer or on the producer's behalf.
Section 5 replaced: N.S. Reg. 121/95.6 Where the producer is not the packer, any levy established by the Commodity Board shall be deducted by the packer from monies due the producer, and shall be remitted to the Commodity Board.
Section 6 replaced: N.S. Reg. 121/95.7 (a) Levies on potatoes marketed in any month shall be remitted to the Commodity Board by the fifteenth day of the following month.
(b) All remittances shall be accompanied by the information requested by the Commodity Board.
(c) Persons who do not remit to the Commodity Board levies when due are subject to the penalties under the Natural Products Act.
Section 7 added: N.S. Reg. 121/95.8 The Commodity Board may require from producers or packers sufficient information to determine the levies due and payable on the marketing of potatoes.
Section 8 added: N.S. Reg. 121/95.9 A producer or packer who fails to register with the Commodity Board, or to remit levies on potatoes marketed under this regulation, or who fails to provide the Commodity Board with information on potatoes marketed and levies due are subject [to] the penalties under the Natural Products Act.
