Commercial Vehicle Transfer of Registration Regulations

made under subsection 302(1) of the

Motor Vehicle Act

R.S.N.S. 1989, c. 293

O.I.C. 86-890 (effective August 1, 1986), N.S. Reg. 191/86



The Governor in Council on the report and recommendation of the Minister of Transportation dated the 27th day of June, 1986, and pursuant to subsection (1) of Section 270 of Chapter 191 of the Revised Statutes of Nova Scotia, 1967, the Motor Vehicle Act, is pleased to revoke Order in Council 69-754 dated the 28th day of July, 1969, and to determine, effective as of and from the lst day of August, 1986, that the fee payable to the Department of Transportation for transfer of registration for commercial vehicles is as provided in the schedule of fees approved under Section 270 of the Motor Vehicle Act, subject to the following conditions:

 

When a commercial vehicle having a registered weight of 5001 kilograms or more that has been registered for any year is traded to a dealer as payment or part payment for another commercial vehicle of a registered weight of 5001 kilograms or more, the fee paid with respect to the registration of the vehicle so traded shall on application of the purchaser be applied towards the registration fee of the vehicle for which it was traded if

 

                (a)    the permit and the certificate of title of the vehicle that was traded have been assigned to a dealer licensed in Nova Scotia to whom it was traded;

 

                (b)    the permit, certificate of title and number plates of the vehicle that was traded are returned to the Registrar;

 

                (c)    an application for registration of the vehicle for which it was traded is made to the Registrar; and

 

                (d)    a fee to cover the transfer is paid to the Registry.
