Refund of Registration Fees Regulations

made under subsection 302(1) of the

Motor Vehicle Act

R.S.N.S. 1989, c. 293

as amended to O.I.C. 2015-96 (March 31, 2015, effective June 1, 2015), N.S. Reg. 131/2015

 

1     (1)    Subject to the other provisions of this Section, of the registration fee paid for a motor vehicle registered for a weight up to 5000 kilograms or a trailer registered for a weight of 1501 kilograms or more for any registration period, there shall be refunded one-twelfth of the annual registration fee or one twenty-fourth of the two year registration fee for each month remaining in the registration period less the sum of $13.10 and applicable taxes when the Registrar is satisfied that

                (a)    the number plates and permit issued for the vehicle are returned to the Registrar of Motor Vehicles; or

 

                (b)    for vehicles which have left the Province there is delivered to the Registrar a certificate issued in another province that the plates and permit were surrendered to an official of that province; or

 

                (c)    it is made to appear to the Registrar by statutory declaration or otherwise that the number plates and permit, or any of them that have not been returned, have been lost, stolen or destroyed; and

 

                (d)    the refund to which the applicant is entitled is not less than $3.00.

 

       (2)    Subject to the other provisions of this Section, of the registration fee paid for a commercial vehicle registered for a weight of 5001 kilograms or more for a full year registration period, there shall be refunded one-twelfth of the annual registration fee for each month remaining in the period less the sum of $13.10 and applicable taxes when the Registrar is satisfied that the vehicle is sold or transferred, replaced by a vehicle of light commercial weight, junked, repossessed, has left the Province, or the plate owner is deceased; and

                (a)    the number plates and permit issued for the vehicle are returned to the Registrar of Motor Vehicles; or

 

                (b)    for vehicles which have left the Province there is delivered to the Registrar a Certificate issued in another province that the plates and permit were surrendered to an official of that province; or

 

                (c)    it is made to appear to the Registrar by statutory declaration or otherwise that a number plate or permit that has not been returned has been lost, stolen or destroyed; and

 

                (d)    the refund to which the applicant is entitled is not less than $3.00.

 

       (3)    When the registration fee or a portion thereof for a vehicle is refunded pursuant to this Section, the Registrar shall refund the amount to the registered owner, or the personal representative or assignee of the registered owner.

 

       (4)    In calculating the amount of the refund for the purpose of this Section, only the number of full months remaining in the registration year shall be considered.

       (6)    (a)    Clauses (1)(a), (b) and (c) and clauses (2)(a), (b) and (c) do not apply to the following reduced fee registration vehicles:

 

                         (i)      a vehicle for which the registration has no expiry date,

 

                         (ii)     a farm or fishermen [fisherman’s] truck,

 

                         (iii)    a vehicle owned by the Province of Nova Scotia,

 

                         (iv)    a vehicle with a restricted nominal fee,

 

                         (v)     miscellaneous equipment,

 

                         (vi)    a service truck,

 

                         (vii)   a farm tractor,

 

                         (vii)   an antique auto,

 

                         (viii)  an ambulance,

 

                         (ix)    a hearse.

 

                (b)    A reduced registration vehicle referred to in clause (a) is eligible for refund only if the registered owner is converting from a reduced fee registration to a full registration of the vehicle. The amount of the registration fees refunded under this Section shall be the fee paid less one-twelfth of the annual registration fee for the vehicle for each month (or portion of a month) used in the period less the sum of $13.10 and applicable taxes.

                (c)    No refund will be made where the applicant is entitled to less than $3.00.

 

       (7)    When the permit and stickers for a vehicle are returned to the Registrar in the unopened envelope or package in which they were sent from the Department or if the Registrar is otherwise satisfied that the permit and stickers were not used, the Registrar shall refund the full amount of the registration fee paid by the registered owner less the fee of $13.10 and applicable taxes provided the documents are returned during the registration year and provided that, if number plates were issued at the same time as the permit and sticker, the number plates are also returned.

2     (a)    Where the Registrar is satisfied that a driver's license has been returned to the Registry for the reason that the license holder is unable to drive for reason of incapacity or inability, the Registrar shall refund a portion of the license fee paid based on the number of full unused months remaining in the license period less the sum of $13.10 and applicable taxes.

       (b)    Where the Registrar is satisfied that a driver has taken up residence in another jurisdiction, the Registrar shall refund a portion of the license fee paid based on the number of full unused months remaining in the license period less the sum of $13.10 and applicable taxes.

       (c)    No refund will be made where the applicant is entitled to less than $3.00.

 

       (d)    This Section does not apply to a short term registration administration fee or to a production of photo license fee, both of which are non-refundable.
