Clam Harbour Provincial Park Designation

made under Section 8 of the

Provincial Parks Act

R.S.N.S. 1989, c. 367

O.I.C. 80-640 (May 13, 1980), N.S. Reg. 81/80


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 7th day of May, A.D., 1980, and pursuant to Section 2 of Chapter 244 of the Revised Statutes of Nova Scotia, 1967, the Provincial Parks Act, is pleased to constitute all that area of land situate at Clam Harbour, in the County of Halifax, owned by Her Majesty in the right of the Province of Nova Scotia, to be a Provincial Park, the said area of land being described in Schedule “A” and shown outlined in red on the copy of Crown Land Records Plan No. E-11-14 marked Schedule “B”, both schedules attached to and forming part of the report and recommendation.



Schedule “A”


All those two certain lots, pieces or parcels of land situate, lying and being at Clam Harbour, in the County of Halifax, Province of Nova Scotia, as shown on Plan No. E-11-14 filed in the Crown Land Record Office, Department of Lands and Forests, Halifax, and being more particularly described as follows:


Parcel “A”

Beginning at Crown Land Iron Post No. H6301 situate on the eastern boundary of the Clam Bay Beach Road and being (by grid bearings referred to the Nova Scotia Modified 3° Transverse Mercator Projection, Zone 5, central meridian 64° 30' west longitude) N 63° 04' 41" E a distance of 678.37' from Nova Scotia Control Monument No. 15157;


Thence (from the place of beginning) S 29° 25' 35" E along a southwestern boundary of lands of various owners, a distance of 224.17' to Crown Land Iron Post No. H6302;


Thence S 59° 25' 24" E continuing along a southwestern boundary of lands of various owners, a distance of 241.23' to Crown Land Iron Post No. H6303;


Thence continuing S 59° 25' 24" E along the southwestern boundary of lands of various owners, a distance of 9', more or less, to the approximate mean high water mark of Clam Harbour;


Thence in a southeasterly, northeasterly, southwesterly and northwesterly direction along the central and various courses of the approximate mean high water mark of Clam Harbour, the Atlantic Ocean and Clam Bay a distance of 30478', more or less, to a point situate on the eastern boundary of a public highway leading from Lake Charlotte to Clam Harbour;


Thence in a northwesterly direction along the eastern boundary of the said public highway a distance of 390', more or less, to Crown Land Iron Post No. H6316 marking the southwestern corner of lands of Gordon Hamond [Hammond] as recorded at the Registry of Deeds Office in Halifax, in Book 2500 at Page 850;


Thence N 46° 32' 39" W along the southern boundary of the Gordon Hammond lands, a distance of 4828.36' to Crown Land Iron Post No. H6315 situate on the western boundary of the aforementioned Clam Bay Beach Road;


Thence in a southeasterly direction along the western boundary of the Clam Bay Beach Road a distance of 3670', more or less, to a point;


Thence S 29° 25' 35" E, a distance of 80', more or less, to the place of beginning.


Parcel “A” to also include a small island, to the northeast of Harbour Point, shown outlined in red on the abovementioned plan.


The above described Parcel “A” contains 406.5 acres, more or less.


Parcel “B”

Beginning at Crown Land Iron Post No. H6313 situate (by grid bearings referred to the Nova Scotia Modified 3° Transverse Mercator Projection, Zone 5, central meridian 64° 30' west longitude) N 45° 05' 27" W, a distance of 2410.36' from Nova Scotia Control Monument No. 15156 said iron post also marking a southeastern corner of lands of Catherine (Fogo) Cook as recorded in the Registry of Deeds Office in Halifax in Book 2334 at Page 719;


Thence (from the place of beginning) N 28° 50' 27" E along a southeastern boundary of the lands of Catherine Cook, a distance of 129.58' to a point;


Thence continuing N 28° 50' 27" E along the southeastern boundary of the lands of Catherine Cook, a distance of 130.53' to a point;


Thence N 34° 06' 09" E continuing along the southeastern boundary of the lands of Catherine Cook, a distance of 46.64' to a point;


Thence N 55° 41' 56" E continuing along the southeastern boundary of the lands of Catherine Cook, a distance of 124.72' to Crown Land Iron Post No. H6312;


Thence continuing N 55° 41' 56" E along the southeastern boundary of the lands of Catherine Cook, a distance of 12', more or less, to a point situate on or near the approximate mean high water mark of Clam Harbour;


Thence in a southeasterly, southwesterly, northwesterly and southerly direction along the several and various courses of the approximate mean high water mark of Clam Harbour a distance of 5329', more or less, to a point marking the northeastern corner of lands of various owners;


Thence N 31° 21' 12" W along the northern boundary of lands of various owners, 16' more or less, to Crown Land Iron Post No. H6304;


Thence continuing N 31° 21' 12" W along the northern boundary of lands of various owners, 59.00' to Crown Land Iron Post No. H6305;


Thence continuing N 31° 21' 12" W along the northern boundary of lands of various owners, a distance of 105.45' to Crown Land Iron Post No. H6306;


Thence continuing N 31° 21' 12" W along the northern boundary of the lands of various owners, a distance of 11.80' to Crown Land Iron Post No. H6307;


Thence N 69° 02' 42" W continuing along the northern boundary of lands of various owners, a distance of 85.43' to Crown Land Iron Post No. H6308;


Thence N 46° 25' 08" W continuing along the northern boundary of lands of various owners, a distance of 21.60' to Crown Land Iron Post No. H6309;


Thence continuing N 46° 25' 08" W along the northern boundary of lands of various owners, a distance of 117.97' to Crown Land Iron Post No. H6310;


Thence N 41° 55' 32" W continuing along the northern boundary of lands of various owners, a distance of 114.16' to Crown Land Iron Post No. H6311;


Thence continuing N 41° 55' 32" W along the northern boundary of lands of various owners, a distance of 2.61' to Crown Land Iron Post No. H6311A situate on the eastern boundary of the Clam Bay Beach Road;


Thence in a northerly direction along the eastern boundary of the Clam Bay Beach Road, a distance of 655' more or less, to Crown Land Iron Post No. H6314 situate on a southern boundary of the lands of Catherine Cook and also marking the northern boundary of the Grassy Field Point Road (so-called);


Thence in an easterly direction along the southern boundary of the lands of Catherine Cook and the northern boundary of the Grassy Field Point Road (so called) a distance of 376', more or less, to the place of beginning.


The above described Parcel “B” contains 41 acres, more or less.


Saving and reserving therefrom in Her Majesty the Queen, all minerals other than agricultural limestone, gypsum and building materials as defined in Chapter 12 of the Statutes of Nova Scotia, 1975, the Mineral Resources Act; all water courses as defined in Chapter 335 of the Revised Statutes of Nova Scotia, 1967, the Water Act and amendments thereto, and all common and public highways or any part thereof as defined in Chapter 248 of the Revised Statutes of Nova Scotia, 1967, the Public Highways Act and amendments thereto, which highways are situate within the boundaries of the above described land; and the above described land to be subject to any and all existing easements and rights of way.
