Rushton Beach Provincial Park Designation

made under Section 8 of the

Provincial Parks Act

R.S.N.S. 1989, c. 367

O.I.C. 78-787 (July 11, 1978), N.S. Reg. 143/78


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 29th day of June, A.D., 1978, pursuant to Section 2 of Chapter 244 of the Revised Statutes of Nova Scotia, 1967, the Provincial Parks Act, is pleased to

 

       (a)    constitute all that area of land including land covered with water owned by Her Majesty in the right of the Province of Nova Scotia, situate at or near Rushton Beach, in the County of Pictou, Province of Nova Scotia, to be a Provincial Park, said area of land and land covered with water being described in Schedule “A” and shown on Schedule “B”, both attached to and forming part of the report and recommendation, and

 

       (b)    declare that the name of the park shall be known as “Rushton Beach Provincial Park”.

Rushton Beach Provincial Park


All that certain lot, piece, parcel or tract of land situate, lying and being at Marshville in the County of Pictou and Province of Nova Scotia, as shown on a plan of Rushton Beach Provincial Park filed in the Department of Lands and Forests Office at Halifax as C.L.R. File No. E-5-74, which lot is more particularly bounded and described as follows:


Beginning at Crown Land Iron Post 2 situate at the intersection of the eastern boundary of lands now or formerly of Wilbur Murray with the northern boundary of Highway No. 6;


Thence (by astronomic bearings) N 80° 09' E, a distance of 119.2 feet along the northern boundary of said Highway No. 6 to Crown Land Iron Post 6 situate at the southwest corner of lands now or formerly of Mrs. Layton Rushton;


Thence N 15° 51' W, a distance of 308.8 feet along the western boundary of lands now or formerly of said Mrs. Layton Rushton to Crown Land Iron Post 5;


Thence N 80° 09' E, a distance of 281.4 feet along the northern boundary of lands now or formerly of said Mrs. Layton Rushton to Crown Land Iron Post 9;


Thence S 16° 12' E, a distance of 309.3 feet along the eastern boundary of lands now or formerly of said Mrs. Layton Rushton to a point on the northern boundary of the aforementioned Highway No. 6;


Thence N 80° 20' E, a distance of 20 feet along the northern boundary of said Highway No. 6 to Crown Land Iron Post 3;


Thence N 74° 11' E, a distance of 426.8 feet along the northern boundary of said Highway No. 6 to Crown Land Iron Post 1006;


Thence N 15° 49' W, a distance of 648.2 feet to Crown Land Iron Post 1005;


Thence N 74° 14' E, a distance of 430.0 feet to Crown Land Iron Post 1004;


Thence N 15° 40' W, a distance of 897.4 feet along a western boundary of lands now or formerly of Leonard MacArthur to Crown Land Iron Post 1802;


Thence continuing N 15° 40' W, a distance of 10 feet more or less to the southern shore of a creek;


Thence in a general northwesterly and southwesterly direction a distance of 603 feet more or less along the southern shore of said creek to Crown Land Iron Post 1002;


Thence N 15° 49' W, a distance of 670.8 feet crossing said creek and along the western boundary of lands now or formerly of Ralph Langille to Crown Land Iron Post 1001;


Thence continuing N 15° 49' W, a distance of 95 feet more or less to the mean high water mark of Amet Sound;


Thence in a general southwesterly direction a distance of 1,000 feet more or less along the mean high water mark of said Amet Sound to the northerly prolongation of the eastern boundary of lands now or formerly of the aforementioned Wilbur Murray;


Thence S 16° 38' E, a distance of 120 feet more or less crossing the aforementioned creek and following the eastern boundary of lands now or formerly of said Wilbur Murray to Crown Land Iron Post 1;


Thence continuing S 16° 38' E, a distance of 1,620.5 feet along the eastern boundary of lands now or formerly of said Wilbur Murray to the place of beginning.


This lot contains 46.3 acres more or less.
