Sand Hills Beach Provincial Park Designation

made under Section 8 of the

Provincial Parks Act

The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 7th day of April, A.D., 1976, pursuant to the provisions of Section 2 of Chapter 244 of the Revised Statutes of Nova Scotia, 1967, the Provincial Parks Act, is pleased to

 

                (a)    constitute all that area of land including land covered with water owned by Her Majesty in the right of the Province of Nova Scotia and situate at or near Sand Hills Beach, in the County of Shelburne, Province of Nova Scotia, to be a Provincial Park, said area of land being included within the boundaries of the lands described in Schedule “A” attached to and forming part of the report and recommendation, and shown outlined on the Plan of Survey marked Schedule “B” also attached to and forming part of the report and recommendation;

 

                (b)    declare the name by which the park shall be known as “Sand Hills Beach Provincial Park”.

Sand Hills Beach Provincial Park


All those certain lots, pieces, or parcels of land situate, lying, and being at or near Villagedale, in the County of Shelburne, Province of Nova Scotia, shown as Lot 1 and Lot 2 on Field Plot No. P-018/88, the said plan being filed in the Department of Lands and Forests Office, Dartmouth.


Lot 1

The said Lot 1 being more particularly described as follows:


Beginning at Survey Marker No. 373, said survey marker being situate on the western boundary of the Villagedale Road;


Thence (by astronomic bearings) N 70° 52.6' W, a distance of 270.66 feet to Survey Marker No. 374;


Thence S 01° 59.8' W, a distance of 277.79 feet to Survey Marker No. 375;


Thence N 83° 42.7' W, a distance of 445.17 feet to a point;


Thence N 88° 20.6' W, a distance of 100.00 feet to a point;


Thence N 46° 57.7' W, a distance of 385.24' to Survey Marker No. 358;


Thence N 44° 17.0' W, a distance of 98.48 feet to Survey Marker No. 359;

Thence westerly, northerly and northwesterly following the several courses of the ordinary high water mark of Barrington Bay to Beach Point;


Thence northeasterly and northerly following the several courses of the ordinary high water mark of Barrington Bay to Liberty Point;


Thence southeasterly and easterly following the several courses of the ordinary high water mark of Barrington Bay along Allen Flats to Bakers Brook;


Thence northeasterly following the several courses of Bakers Brook to the western boundary of the Old Post Road;


Thence S 01° 53.4' E, along the western boundary of said Old Post Road 181.5 feet to a point;


Thence S 30° 14.9' E, along the western boundary of said Old Post Road 698.23 feet to a point on the western boundary of said Villagedale Road;


Thence S 04° 54.8' E, along the western boundary of said Villagedale Road 105.96 feet to a point;


Thence S 01° 07.9' W, along the western boundary of said Villagedale Road 923.97 feet to Survey Marker No. 378;


Thence S 66° 23.7' W, a distance of 100.0 feet to Survey Marker No. 379;


Thence S 07° 21.3' W, a distance of 125.0 feet to Survey Marker No. 380;


Thence N 74° 29.4' E, a distance of 96.38 feet to Survey Marker No. 381, said survey marker being situate on the western boundary of said Villagedale Road;

Lot 2

Together with Lot 2, the said Lot 2 being more particularly described as follows:


Beginning at Survey Marker No. 366, said survey marker being situate at the intersection of the eastern boundary of Villagedale Road with the southern boundary of land now or formerly of Stanley Lamrock;


Thence (by astronomic bearings) N 82° 43.9' E, along the southern boundary of land now or formerly of Stanley Lamrock 273.96 feet to Survey Marker No. 365;


Thence N 04° 20.6' E, along the southern boundary of land now or formerly of Stanley Lamrock 225.74 feet to Survey Marker No. 364;


Thence N 66° 07.5' E, along the southern boundary of land now or formerly of Stanley Lamrock 449.41 feet to Survey Marker No. 363;


Thence S 32° 42.3' E, a distance of 545.39 feet to Survey Marker No. 362;


Thence S 65° 04.1' W, a distance of 1228.56 feet to Survey Marker No. 361, said survey marker being situate on the eastern boundary of said Villagedale Road;


Thence N 12° 41.6' E, along the eastern boundary of said Villagedale Road 548.85 feet to the place of beginning.


The above described Lot 1 and Lot 2 contain a total area of 175 acres more or less.

The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 1st day of August, A.D., 1989, pursuant to Section 16(1)(a) of Chapter 5 of the Statutes of Nova Scotia, 1987, the Crown Lands Act, and Section 8(c) of Chapter 18 of the Statutes of Nova Scotia, 1988, the Provincial Parks Act, is pleased to

 

                (a)    approve the alteration of the boundary of lands situate at or near Villagedale, in the County of Shelburne, constituted as Sand Hills Beach Provincial Park by Order in Council 76-558 dated the 11th day of May, A.D., 1976, and amended by Order in Council 88-406 dated the 20th day of April, A.D., 1988, by terminating the status of 27,000 square feet, more or less, of Sand Hills Beach Provincial Park shown shaded in yellow on the plan marked Schedule “A” attached to and forming part of the report and recommendation;

 

                (b)    approve Petition No. 33419 for the conveyance of a lot of Crown land containing 55,500 square feet, more or less, situate at or near Villagedale, in the County of Shelburne, as shown outlined in green on the plan marked Schedule “B” attached to and forming part of the report and recommendation to David Wilson and E. Lois Wilson, his wife, as joint tenants and not as tenants in common, of Brass Hill, in the County of Shelburne, and to order that a quit claim deed be executed by the Minister of Lands and Forests on behalf of Her Majesty the Queen in right of the Province of Nova Scotia, to convey the said lot of land containing 55,500 square feet, more or less, subject to rights of way to adjacent cottage lot owners, to David Wilson and E. Lois Wilson, at a cost of Sixteen Thousand Six Hundred and Fifty Dollars ($16,650.00), based on the appraised value of $0.30 per square foot, with the exact cost to be determined by a legal survey, plus all costs as defined by the Minister of Lands and Forests;

 

                (c)    approve Petition No. 33430 for the conveyance of a lot of Crown land containing 47,200 square feet, more or less, situate at or near Villagedale, in the County of Shelburne, as shown outlined in red on the plan marked Schedule “B” attached to and forming part of the report and recommendation to Patsy Ford of Yarmouth, in the County of Yarmouth, and to order that a quit claim deed be executed by the Minister of Lands and Forests on behalf of Her Majesty the Queen in right of the Province of Nova Scotia, to convey the said lot of land containing 47,200 square feet, more or less, subject to rights of way to adjacent cottage lot owners, to Patsy Ford at a cost of Fourteen Thousand One Hundred and Sixty Dollars ($14,160.00), based on the appraised value of $0.30 per square foot, with the exact cost to be determined by a legal survey, plus all costs as defined by the Minister of Lands and Forests;

 

                (d)    authorize the Minister of Lands and Forests to execute such other documents as may be necessary to achieve the purposes of this order.
