Abercrombie Wildlife Management Area Designation and Regulations

made under Section 113 of the
Wildlife Act
R.S.N.S. 1989, c. 504
O.I.C. 77-1417 (November 15, 1977), N.S. Reg. 147/77

The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 8th day of November, A. D., 1977, pursuant to Section 161(6) of Chapter 163 of the Revised Statutes of Nova Scotia, 1967, the Lands and Forests Act, Part III-Game, is pleased to:

(a) declare that the area described in Schedule "A" and shown outlined in red on Schedule "B", both Schedules attached to and forming part of the report and recommendation, be a wildlife management area, to be known as the Abercrombie Wildlife Management Area;

(b) make regulations in the form set out in Schedule "C" attached to and forming part of the report and recommendation, for the control of the wildlife management area and the management of the wildlife therein.


Schedule "A" - Abercrombie Wildlife Management Area

All that certain parcel, piece or lot of land situate, lying and being at or near Abercrombie, County of Pictou, Province of Nova Scotia, being and intending to be the Abercrombie Wildlife Management Area, as shown on the attached plan, dated 13 September, 1977 and being more particularly described as follows:

Beginning at a Crown Land Iron Post (C.L.I.P.) shown as C.L.I.P. No. 1 on the above mentioned plan, the said Post being set on the southwestern boundary line of the road to Scott Pulp Mill and being N 44º 47' 55" W, distant 254.98 feet more or less from Nova Scotia Coordinate Monument (N.S.C.M.) No. 4191;

From thence in a southeasterly direction along the said road boundary line, distant 3250 feet more or less to an iron post set at the intersection of the said road boundary line and the northwestern boundary line of lands of Oressa Sinclair;

Thence S 75º 46' 05" W, by grid bearings based on the 3º Modified Transverse Mercator Projection, Zone 4, central meridian 61º 30" west longitude, along the said Sinclair lands distant 235.87 feet more or less to a C.L.I.P.;

Thence S 16º 50' 20" E along the said Sinclair lands distant 221.37 feet more or less to a C.L.I.P.;

Thence N 75º 18' 55" E, along the said Sinclair lands, distant 338.22 feet more or less to a C.L.I.P. set on the southwestern boundary line of the road to Scott Pulp Mill;

Thence in a southeasterly direction along the said road boundary, distant 430 feet more or less to the intersection of the said road boundary and the northwestern boundary of the Abercrombie Road leading from Highway No. 106 to New Glasgow;

Thence in generally a southwesterly, northwesterly southwesterly, northwesterly and northeasterly direction along the many courses of the northern boundary line of the Abercrombie Road, the northern boundary line of the exit ramp from the Abercrombie Road to Highway No. 106 and the eastern boundary line of Highway No. 106, distant 10,300 feet more or less to a C.L.I.P., identified as No. 3 on the said plan;

Thence S 45º 14' 45" E distant 2431.20 feet more or less to a C.L.I.P. identified as No. 2 on the said plan;

Thence N 44º 45' 00" E, distant 2594.88' feet more or less to the place of beginning. The said parcel, piece or lot of land containing 350 acres be the same more or less;

Also all that certain parcel, piece or lot of land situate, lying and being at or near Abercrombie, County of Pictou, Province of Nova Scotia, and being more particularly described as follows:

Beginning at a point on the northeastern boundary line of Highway No. 106, the said point being, by grid bearing based on the 3º Modified Transverse Mercator Projection, Zone 4, central meridian 61° 30' west longitude, N 17° 07' 34" E, distant 2919.58 feet more or less from C.L.I.P. No. 3 set on the northeastern boundary line of Highway No. 106;

From thence in a northeasterly direction and perpendicular to the said Highway boundary line, distant 196 feet to a point;

Thence in a northwesterly direction, distant 820 feet to a point;

Thence in a southwesterly direction, distant 196 feet more or less to the northeastern boundary line of Highway No. 106;

Thence in a southeasterly direction along the said Highway boundary line, distant 820 feet more or less to the Point of Beginning. The said parcel, piece or lot of land being and intending to be a management area around driven piles for Cormorants and having an area of 3.7 acres be the same more or less.

Schedule "C"
Regulations for the Management of the Abercrombie Wildlife Management Area
made pursuant to Section 161 of the Lands and Forests Act.

1 In these regulations,

(a) "Department" means the Department of Lands and Forests;

(b) "firearm" means any barrelled weapon or bow from which any shot, bullet or missile can be discharged and includes anything that can readily be adapted for use as a firearm;

(c) "Minister" means the Minister of Natural Resources;

(d) "vehicle" means every device in, upon or by which any person or property is or may be transported and includes a boat, canoe or other water conveyance or any snowmobile;

(e) "Wildlife Management Area" means the Abercrombie Wildlife Management Area and includes the double-crested cormorant colony located between Abercrombie Point and the causeway leading to the town of Pictou.

2 (1) Except as authorized under these regulations, it shall be an offence for any person to possess or discharge any firearm within the boundaries of the Wildlife Management Area.

(2) Except as authorized under these regulations, it shall be an offence for any person to enter the Wildlife Management Area by means of a vehicle.

(3) Subsection (2) does not apply to visitors who enter the Wildlife Management Area for the purpose of viewing wildlife, forest practices and picnicing in such areas as are designated by the Department and those employees of Scott Paper Company who are housed within or working in the Wildlife Management Area by virtue of their employment.

(4) Except as authorized by the Minister, it shall be an offence to kill, take, hunt, trap or chase, pursue, worry, follow after or on the trail of or search for any wild mammals or birds within the Wildlife Management Area.

(5) Except as authorized by the Minister, it shall be an offence for any person to be in possession of any trap, snare, poison, wild mammal or bird or the carcass or any part of any wild mammal or bird within the boundaries of the Wildlife Management Area.

3 (1) Notwithstanding Section (2) [2] of these regulations, those persons employed by the Department when in performance of their Departmental duties, may

(a) possess and discharge a firearm within the boundaries of the Wildlife Management Area;

(b) enter the Wildlife Management Area by means of a vehicle;

(c) kill, take, hunt, trap, or chase, pursue, worry, follow after or on the trail of or search for wild mammals or birds within the Wildlife Management Area;

(d) be in possession of any trap, snare, poison, wild mammals or birds or the carcass or any part of any wild mammal or bird within the boundaries of the Wildlife Management Area.

4 (1) It shall be an offence for any person to permit a dog or other animal owned by them, in their care or brought by them within the Wildlife Management Area to run at large.

(2) For the purpose of subsection (1) a dog or other animal is deemed to be at large unless such dog or other animal is on a leash which does not exceed six feet in length.

5 (1) For the purpose of these regulations, the employees of Scott Paper Company, who by virtue of their employment are housed in the Survey House, so called, within the Wildlife Management Area, may possess at that location firearms, traps and snares for the purpose of storage.

(2) The firearms, traps and snares mentioned in subsection (1), while being transported to and from or being stored at the Survey House, so called, are to be made unoperable during these periods.

6 These regulations shall come into force on the 15th day of November, A.D., 1977.
