Debert Wildlife Management Area Designation and Regulations

made under Section 113 of the
Wildlife Act
R.S.N.S. 1989, c. 504
O.I.C. 73-884 (August 21, 1973), N.S. Reg. 76/73

The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 12th day of July, A.D., 1973, pursuant to subsection (1), clause (c) and subsection (6), clause (a) of Section 161 of Chapter 163, of the Revised Statutes of Nova Scotia, 1967, the Lands and Forests Act, is pleased to:

(a) declare that the area described in Schedule "A" and shown outlined in red on Schedule "B", both schedules attached to the report and recommendation, shall no longer be a Sanctuary and revoke the Order in Council dated the 27th day of September, A.D., 1962, and the regulations thereto;

(b) declare that the area described in Schedule "C" and shown outlined in red on Schedule "D", both schedules attached to the report and recommendation, be a Wildlife Management Area to be known as the Debert Wildlife Management Area;

(c) make regulations in the form set out in the Schedule "E" attached to the report and recommendation, for the control of the Wildlife Management Area and the Management of Wildlife therein.


Schedule "A"

Beginning at an iron post standing in the North boundary of highway route number 2 and 4, marking the South-west angle of Grant Number 22665 Department of Agriculture (Canada) Colchester County;

From thence to run by Magnetic bearings in the year 1951 North seventeen degrees forty minutes East one thousand twenty-one decimal five feet to an iron post marking the Northwest angle of Grant Number 22665;

Thence South seventy-two degrees twenty minutes East following the North boundary of said Grant three hundred eighty feet to an iron post standing in the West boundary of the old road leading to Debert;

Thence Northerly following the West boundary of said road three hundred feet more or less to its intersection with the West boundary of the new paved road;

Thence continuing Northerly following the West boundary of the new paved road three thousand feet more or less to its intersection with the West boundary of the old road;

Thence continuing Northerly following the West boundary of the old road one thousand two hundred feet more or less to its intersection with the South boundary of a road crossing the head of MacElmon’s Pond and leading to the Debert Airstrip;

Thence Northwesterly following the South boundary of said road six thousand five hundred feet more or less to a stake standing South nine degrees forty-five minutes West across the road from the Southern termination of a fence;

Thence South nine degrees forty-five minutes West three thousand five hundred eighty feet more or less to an iron post marking the North-west angle of land reconveyed to the Crown under Crown Document Number 272;

Thence following the West boundary of said Crown lands South nineteen degrees thirty-seven minutes West three thousand nine hundred ninety-five feet more or less to an iron post standing in the North boundary of highway Routes 2 and 4;

Thence Easterly following the North boundary of said highway six thousand eight hundred feet more or less to the place of beginning containing 665 acres more or less.

Schedule "C"

Schedule "E"
Debert Wildlife Management Area Regulations

1 Except as provided in these regulations, no person shall

(a) kill, take, hunt or pursue or attempt to kill or take any wild animal or bird; or

(b) have in his possession any firearm, trap, snare or poison or any wild animal or bird or the carcass or any part of any wild animal or bird within the limits of the Debert Wildlife Management Area.

2 Anyone may carry a firearm, which has been sealed by a warden, within the Debert Wildlife Management Area.

3 No person shall enter or be within the Debert Wildlife Management Area without first having obtained a written permit from a game warden except for the area designated as a picnic area and described in Section 4 of these regulations and outlined in black on Schedule D of the report and recommendation attached to this report.

4 The following described area of land within the Debert Wildlife Management area shall be designated as a picnic area.

Beginning at the intersection of Galloping Brook and the West boundary of the new paved road to Debert Military Camp;

Thence Northerly along the new paved road five hundred and thirty feet more or less;

Thence South eighty-one degrees West (Magnetic bearing) five hundred feet more or less;

Thence South nine degrees East one thousand and seven hundred feet more or less;

Thence North eighty-one degrees East three hundred and twenty feet more or less to the new paved road;

Thence Northerly along the new paved road twelve hundred feet more or less to the beginning containing nineteen acres more or less.

5 The Minister may by written authorization permit any person to enter the Debert Wildlife Management Area at any time, except Sunday, to kill, take, hunt or capture any wild animal or bird.

6 The Minister may specify the terms and conditions upon which any permit is issued.

7 Where the Minister proposes to permit limited hunting or trapping within the Debert Wildlife Management Area, he shall give public notice thereof in at least one edition of a newspaper having general circulation in the Province.

8 The Minister shall not authorize more than one hundred persons to enter the Debert Wildlife Management Area on any one day for the purpose of hunting or trapping.

9 Every person, except a warden or employee of the Department of Natural Resources, requesting authorization from the Minister to hunt in the Debert Wildlife Management Area, shall

(a) apply for a permit at and enter the Wildlife Management Area through a check station established for that purpose by the Minister or his agent;

(b) possess any other license or permit that may be required by the Wildlife Act or regulations made thereunder;

(c) obtain and wear an identification marker issued by the Minister or his agent.

10 Every person authorized by the Minister to enter the Wildlife Management Area during a limited hunting or trapping period shall

(a) follow all instructions issued by the Minister or his agent with respect to hunting within the Wildlife Management Area;

(b) subject to these regulations, comply with the provisions of the Wildlife Act and regulations;

(c) file a report as required by the Minister or his agent;

(d) turn over to an agent of the Minister any part of the carcass of any wild animal or bird killed or taken within the Wildlife Management Area as required by such agent.

11 (1) No person authorized to hunt within the Wildlife Management Area shall kill or take any wild animal or bird except in accordance with the written authorization referred to in Regulation [Section] 5 hereof.

(2) Any bag limit specified by the Wildlife Act or any regulations shall include any animal or bird taken pursuant to a permit issued by the Minister under these regulations.

12 No person shall allow any dog to run loose within the limits of the Wildlife Management Area.

13 (1) Except as otherwise provided in these regulations, no person shall enter the Wildlife Management Area without first having obtained a written permit from a warden.

(2) Any permit required by these regulations shall be carried by the holder thereof when in the Wildlife Management Area and be produced when requested by a warden.

(3) This regulation shall not apply to the owner of any lands within the limits of the Wildlife Management Area or to his employees.

14 The Governor in Council may appoint one or more persons to be wardens of the Wildlife Management Area.
