Waverley Game Sanctuary Designation and Regulations made under Section 113 of the
Wildlife Act
R.S.N.S. 1989, c. 504
O.I.C. 74-968 (September 3, 1974), N.S. Reg. 84/74
The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 29th day of August, A.D., 1974, and pursuant to Section 161(1) of Chapter 163 of the Revised Statutes of Nova Scotia, 1967, the Lands and Forests Act, is pleased to order that(a) a certain Order in Council made the 11th day of April, A.D., 1936, making regulations with respect to the Game Sanctuary at Miller’s Lake, County of Halifax, and a certain Order in Council dated the 15th day of September, A.D., 1944, declaring an area near Miller’s Lake, County of Halifax, to be a Game Sanctuary known as the Waverley Game Sanctuary, are hereby revoked and rescinded;
(b) an area or areas of the Province described in Paragraph 3 of the regulations attached to and forming part of the report and recommendation shall be a game sanctuary which game sanctuary shall be known as the Waverley Game Sanctuary;
(c) the regulations contained in Schedule "A" attached to and forming part of the report and recommendation are hereby made regulations applicable to the Waverley Game Sanctuary and which regulations are necessary for the control of the Waverley Game Sanctuary and the protection of the wildlife therein, and which are regulations necessary or desirable for the administration and enforcement of the Lands and Forests Act within the boundaries of the Waverley Game Sanctuary.
Schedule "A"
Regulations Under Section 113 of Chapter 504 of the
Revised Statutes of Nova Scotia, 1989, the Wildlife Act1 These regulations may be cited as "Waverley Game Sanctuary Regulations".
2 In these regulations unless the context otherwise specifies the following terms shall be deemed to have the following meanings ascribed to them:
(a) "person" means any person except Her Majesty the Queen in the Right of the Province of Nova Scotia and Her Officers, servants or agents while acting in accordance with the instructions of the Minister of Natural Resources or the Deputy Minister of Natural Resources.
(b) "warden" means such officers, servants or agents of Her Majesty appointed under the Wildlife Act, Revised Statutes of Nova Scotia, 1989, Chapter 504, as amended, and having the powers of a warden under that Act;
(c) "game sanctuary" means the Waverley Game Sanctuary.
3 It shall be unlawful to hunt, take or kill or attempt to take or kill any game in that part of the Province of Nova Scotia which is described as follows:
Starting at the new power dam at Miller’s Lake near Waverley in the County of Halifax;
Thence running northerly along the eastern side of the Old Guysborough Road to the Tote Road into Soldier’s Lake;
Thence following said Tote Road to a post and stone on the shore of Soldier’s Lake;
Thence cross country southeasterly to a post and stone on the shore of Soldier’s Lake at the mouth of Johnson’s River;
Thence following Johnson’s River to the outlet of Preepers Big Lake;
Thence following the eastern shore of Preepers Big Lake to a post and stone;
Thence across country due east to East Lake on the Three Bridges Brook;
Thence following the eastern shore of Three Bridges Brook to Tittle Lake;
Thence along the northern shore of Tittle Lake to the inlet of a brook from Byron Lake;
Thence following the southwestern shore of Byron lake to the foot thereof;
Thence northerly along the eastern shore of Byron Lake to the Waverley District and Preston Township line to a post and stone;
Thence westerly along said township line to Dudley Lake to a post and stone;
Thence following the northern shore line of Dudley lake to the outlet thereof;
Thence following the south side of the outlet to Little Duck Lake;
Thence following by the south shore of Little Duck Lake to the outlet of said lake;
Thence along the southern western shore of Little Duck Lake to the outlet;
Thence following along the southern and eastern shore of said outlet to East Lake;
Thence along the eastern shore of East Lake to the outlet;
Thence along the southern and eastern shore of said outlet to Major Lake;
Thence following the eastern shore of Lake Major to the head thereof;
Thence following the western side of Soldier’s Lake gullys to a post and stone;
Thence northerly across country to a post and stone at Soldier’s Lake at the inlet where the brook from Little Soldier’s Lake enters said lake;
Thence along the southern side of the brook to Little Soldier’s Lake;
Thence along the southern shore of Little Soldier’s Lake to a post and stone;
Thence across country to a post and stone near Gunns Pond;
Thence along the western shore of Gunns Pond and the outlet thereof to the Tote Road from Miller’s Lake;
Thence along said Tote Road to the Old Guysborough Road;
Thence along the eastern side of the Old Guysborough Road to the point of beginning;
Excepting and reserving there from any public highways passing through the above described lands.
4 No person shall at any time hunt, take, injure, trap, snare, shoot, wound, kill or destroy any game animal, fur bearing animal, or other wild animal, or any game bird or other wild bird within the limits of the game sanctuary.
5 No person shall at any time, within the limits of the game sanctuary have in his possession any gun or other firearm or any silencer, trap or snare or poison, or any animal or bird mentioned in the preceding section whether such animal or bird is dead or alive, or any part of such animal or bird.
6 No person shall allow any dog to run loose within the limits of the game sanctuary.
7 No person shall enter the game sanctuary without first having obtained a written permit from a warden. Permits must be carried when in the game sanctuary and be produced when requested by any warden.
8 The wardens shall be under the jurisdiction and authority of the Minister of Natural Resources.
9 Notwithstanding anything in these regulations contained,
(a) where the Minister of Natural Resources has granted a permit to any person which authorizes such person to possess any firearm or kill and possess any animal or bird within the limits of the game sanctuary upon such terms as are stated in the permit,
paragraph[Section] 4 shall not apply to such persons while acting under the authority of such a permit and in accordance with its terms;(b) where a warden has sealed any gun of any person, and while such seal is intact,
paragraph[Section] 5 shall not apply to such person within the limits of the game sanctuary who carries a gun which has been sealed by a warden and with such seal intact;(c)
paragraph[Section] 7 shall not apply to the owner of any land within the limits of the game sanctuary or to such owner’s servants or agents.10 Where in the Wildlife Act or these regulations, any person is exempted from the provisions of that Act or regulations if he has obtained the consent or permission of the Minister of Natural Resources, the Minister of Natural Resources is hereby authorized in his sole discretion to give such consent or permission and upon such terms as the Minister shall deem advisable.
11 These regulations shall come into force on the 3rd day of September, A. D. 1974.
