Margarine Regulations

made under Section 8 of the

Margarine Act

R.S.N.S. 1989, c. 269

as amended to O.I.C. 72-850 (August 8, 1972), N.S. Reg. 58/72


[Note: Effective December 3, 1998, Section 7 of the Margarine Act, which prohibited the manufacture of margarine without a licence, and clause 8(1)(a) of the Act, which enabled the Governor in Council to make regulations respecting licensing, were repealed by Sections 57 and 58 of the Business Efficiency (1998) Act, S.N.S. 1998, c. 8.]


Licences to manufacturers

1     Every application for a licence to manufacture margarine shall be in such form and contain such information as the Minister prescribes.

 

2     The Minister, if satisfied that the premises upon which it is proposed to manufacture margarine are of suitable construction and that they are equipped with adequate sanitary facilities and equipment, will issue a licence in Form A of the Schedule hereto.

 

3     Every licence unless sooner suspended or cancelled expires on the 30th day of November next following the date of issue.

 

4     The fee for a licence is ten dollars ($10.00).

 

5     If it is established to the satisfaction of the Minister that the holder of a licence has violated any provision of the Margarine Act, 1949, or of these regulations, the Minister may suspend the licence for such period as he deems advisable or may cancel the licence.


Standards of quality

6     For the purposes of the Margarine Act, the standards of quality for margarine are as follows:

 

                (a)    margarine shall contain refined oils of animal, fish, marine animal, marine or vegetable origin, or any combination thereof;

 

                (b)    the refined oils mentioned in subsection (a) shall (1) be fit for human consumption and (2) comprise

 

                         (i)     not more than 40%, or

 

                         (ii)    not less than 80%

 

by weight of margarine;

 

                (c)    where the margarine contains milk solids and the refined oils mentioned in subsection (a) of Section 6 comprise

 

                         (1)    not more than 40% by weight of the margarine, the milk solids shall not exceed 2.8% by weight of the margarine,

 

                         (2)    not less than 80% by weight of the margarine, the milk solids shall not exceed 1.4% by weight of the margarine.

Preservatives

7     Margarine shall not contain any preservative except

 

                (a)    common salt;

 

                (b)    benzoic acid or its salts in an amount not in excess of one-tenth of one percent by weight.


Packages

8     No person shall sell or offer for sale any margarine except in a package having legibly marked thereon, in addition to anything required by the Margarine Act, 1949, the kind of oil or fat contained in the margarine stated in terms of vegetable oil, fish oil, animal fat and marine animal fat.

 

9     These regulations come into effect on, from and after, but not before, the 15th day of August, 1949.
