Rehabilitation and Social Development Approval and Assistance Regulations made under Section 27 of the
Social Assistance Act

O.I.C. 74-704 (June 25, 1974), N.S. Reg. 59/741 In these regulations
(a) "Act" means the Social Assistance Act;
(b) "ordinary employment" means a situation of work in which are applied the standards of performance and production of the commonly recognized business or industrial communities;
(c) "sheltered employment" means a situation or work in which are not applied the standards of performance and production of the commonly recognized business or industrial communities;
(d) "sheltered workshop" means a facility in which persons with physical or mental disabilities may, without concern for rate of speed of achievement, work for gain, develop vocational aptitude and skills, or progress towards being employable in ordinary employment;
(e) "activity centre" means a facility which
(i) is designed primarily for use by persons who are not able easily or usually to obtain ordinary employment,
(ii) is operated so as to stress the social and personal development of the persons located therein, and
(iii) facilitates movement to sheltered workshops of persons demonstrating potential therefor;
(f) "work activity" means a situation of work in which persons are, regardless of any difficulties encountered previously in the commonly recognized business or industrial communities or in a form of training, assisted in preparing themselves for obtaining ordinary employment;
(g) "Minister" means the Minister of Community Services;
(h) "applicant" means an applicant who makes a proposal to the Minister and includes an applicant who receives a grant;
(i) "proposal" means a proposal made to the Minister;
(j) "approval" means an approval signed by the Minister;
(k) "grant" means a grant of assistance or reimbursement.
2 Any person, organization, agency, society or municipal unit which is in any way involved with an activity centre, sheltered workshop, work activity or sheltered employment may be an applicant.
3 An applicant may make a proposal to the Minister.
4 A proposal must deal with an activity centre, sheltered workshop, work activity or sheltered employment and with at least one of the activities mentioned in Section 42 of the Act and with no other thing.
5 A proposal shall be in written form.
6 An applicant who makes a proposal shall provide to the Minister such information relative thereto as may be required by the Minister.
7 The Minister may require an applicant to provide, among other things, documentation and evidence to verify all costs and expenses relative to a proposal.
8 The Minister may give an approval of a proposal.
9 The Minister may give an approval of any part of a proposal without giving an approval of any other part of a proposal.
10 The Minister may, as he deems appropriate, make conditions, qualifications, restrictions or requirements in respect of or as a prerequisite to an approval of a proposal or of any part of a proposal.
11 The Minister shall not give an approval of a proposal or of any part of a proposal unless he is satisfied that the activity centre, sheltered workshop, work activity or sheltered employment referred to therein has been or is being or will be established or maintained or continued by the applicant and in the manner required by all applicable statutes and regulations.
12 Where the Minister has given an approval of a proposal or of part of a proposal, he may give a grant to the applicant.
13 The Minister may give a grant in whatever time, form and manner he deems appropriate.
14 The Minister may employ a person on a full-time or part-time basis, or may designate an employee of his department to investigate and report upon the mode and manner of use of any grant.
15 The Minister may appoint such persons as he deems appropriate to advise him in respect of all matters relating to activity centres, sheltered workshops, work activity and sheltered employment.
16 These regulations may be cited as the Rehabilitation and Social Development Approval and Assistance Regulations.
