The Governor in Council, on the report and recommendation of the Attorney General and Minister of Justice dated February 26, 2025, and pursuant to Section 33 of Chapter 5 of the Acts of 1993, the Freedom of Information and Protection of Privacy Act, Section 4 of Chapter 42 of the Acts of 2008, the Privacy Review Officer Act, and Section 18 of Chapter 235 of the Revised Statutes of Nova Scotia, 1989, the Interpretation Act, is pleased, effective March 1, 2025, to:         

        (a) appoint Carmen Stuart as Acting Review Officer pursuant to Section 33 of the Freedom of Information and Protection of Privacy Act;

        (b) appoint Carmen Stuart as Acting Privacy Review Officer pursuant to Section 4 of the Privacy Review Officer Act;

        (c) order that the Province shall defend, negotiate or settle claims or charges made against Carmen Stuart and indemnify her from personal liability in connection with any such claim, provided, however, that the Province is satisfied that the claim arises out of her activities in relation to her appointment, and is not based on fraud or criminal activity and where the Province so defends her, the Province will be in control of the case.
