Provincial Court Act
The Governor in Council on the report and recommendation of the Minister of Justice dated May 4, 1999, pursuant to Section 21 of Chapter 238 of the Revised Statutes of Nova Scotia, 1989, the Provincial Court Act, as amended, is pleased to receive the report of the Nova Scotia Judicial Salary Tribunal dated March 19, 1999, containing its recommendations pertaining to the salaries and benefits for Provincial and Family Court Judges for the fiscal years 1999/2000 to 2001/2002 inclusive, and is pleased to order the Tribunal's recommendations be implemented and that accordingly: 1. The salaries of the Judges of the Provincial Court and Family Court shall be paid at the following rates: Effective April 1, 1999: (a) $130,000 per annum, with an additional $10,000 per annum for the Chief Judge and an additional $5,000 per annum for the Associate Chief Judge; and (b) $524.19 per diem for Judges presiding in those Courts and not receiving an annual salary. Effective April 1, 2000: (a) $137,000 per annum, with an additional $10,000 per annum for the Chief Judge and an additional $5,000 per annum for the Associate Chief Judge; and (b) $552.42 per diem for Judges presiding in those Courts and not receiving an annual salary. Effective April 1, 2001: (a) $144,000 per annum, with an additional $10,000 per annum for the Chief Judge and an additional $5,000 per annum for the Associate Chief Judge; and (b) $580.65 per diem for Judges presiding in those Courts and not receiving an annual salary. 2. The terms of the Province's Short Term Illness Plan be formally extended to provincially appointed judges effective April 1, 1999. 3. The terms of the Province's Long Term Disability Plan continue to govern provincially appointed judges except that the existing "cap" on benefits be deleted, and substituted with 65% of applicable annual salary, with the difference being funded by Government.
