TRANSPORTATION/PUBLIC WORKS--HIGHWAY 104-OMNIBUS AGREEMENT

The Supreme Court of Nova Scotia ruled today that the Highway 104
Western Alignment omnibus agreement should be made public under
the Freedom of Information and Protection of Privacy Act.

Mr. Justice William Kelly made his ruling on the contract which
outlines terms under which the new Western Alignment expressway
is being built. Mr. Justice Kelly denied the appeal of the
Atlantic Highways Corporation (AHC), the private sector partner
building the new road, which is seeking to keep the information
private.

However, the omnibus agreement cannot be made public until March
13, 1997 at the earliest because of further proceedings at the
Court of Appeal. Justice Kelly delayed the effect of his decision
to give AHC time to appear before the Court of Appeal.

Today's court hearing came after a decision by the province to
release the omnibus agreement to all four applicants under the
Freedom of Information and Protection of Privacy Act.
