Big Pond Beach Designation
made under subsection 5(1) of the
Beaches Act

The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 20th day of July, A.D., 1977, and pursuant to Section 5(1) of Chapter 6 of the Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act, is pleased to designate as a beach an area of land lying landward from the mean highwater mark of Big Pond Beach, in the County of Cape Breton, Province of Nova Scotia, as shown outlined in red on the copy of Crown Lands Records Office Plan No. E-7-89, marked Schedule “B” and described in Schedule “A” both Schedules attached to and forming part of the report and recommendation.
Schedule “A”
All that certain area of land lying landward from the mean highwater mark of Big Pond Beach situated at Sydney Mines, in the County of Cape Breton, in the Province of Nova Scotia as shown on the copy of Crown Land Records Office Plan No. E-7-89, attached hereto and being more particularly described as follows:
Beginning at Iron Post No. 1, situated (by grid bearings based on the Nova Scotia three degree Modified Transverse Mercator Projection Zone 4, central meridian sixty-one degrees and thirty minutes west longitude) south forty-one degrees thirty-four minutes twenty seconds east a distance of five hundred eighteen decimal twenty-two feet from Nova Scotia Control Survey Monument No. 1503;
Thence south thirty degrees fifty-two minutes forty seconds east a distance of six hundred twenty-five decimal twenty-eight feet to iron post No. 2;
Thence south fifty-four degrees seven minutes thirty seconds east a distance of one thousand five hundred seventy decimal ninety-five feet to iron post No. 3;
Thence north seventy-eight degrees thirty-seven minutes twenty seconds east a distance of four hundred twenty-five decimal seventy-five feet to iron post No. 4 situated south eighty-one degrees fifty-seven minutes forty seconds west a distance of one thousand eight hundred thirty-one decimal ninety-eight feet from Nova Scotia Control Survey Monument No. 1634;
Thence north thirteen degrees fifteen minutes fifty seconds east a distance of eighty decimal eight feet to a point on the mean highwater mark of Big Pond Beach;
Thence in a north westerly direction, along the mean highwater mark of Big Pond Beach two thousand five hundred feet more or less to a point;
Thence south twenty-five degrees fifty minutes forty seconds west a distance of one hundred twenty-seven decimal six feet to the place of beginning.

All that certain area of land lying landward from the mean high watermark of Big Pond Beach, situate at Sydney Mines, in the County of Cape Breton, in the Province of Nova Scotia as shown on the copy of Crown Land Records Office Plan No. E-7-89A, attached hereto and being more particularly described as follows:
Beginning at Nova Scotia Co-ordinate Monument No. 1634;
From Thence (by grid bearings referred to the Nova Scotia Three Degree Modified Transverse Mercator Projection, Zone 4, Central Meridian sixty-one degrees thirty minutes west longitude) S 58° 33' 50" W a distance of 998.4' to a point;
Thence N 82° 32' 30" W a distance of 1391.3' to a point;
Thence N 78° 37' 20" E a distance of 425.75' to a point;
Thence N 13° 15' 50" E a distance of 80.8' more or less to a point situate on the mean high watermark of Big Pond Beach;
Thence in an easterly direction along the mean high watermark of Big Pond Beach 1900' more or less to a point;
Thence S 31° 03' 20" E a distance of 30' more or less to the place of beginning.
