Church Point Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 82-558 (May 4, 1982), N.S. Reg. 95/82


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 8th day of April, A.D., 1982, pursuant to Section 5(1) of Chapter 6 of the Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act, is pleased to designate as a beach an area of land lying landward from the mean high watermark of Church Point Beach, in the County of Digby, Province of Nova Scotia, as shown outlined in red on the copy of Crown Land Records Office Plan No. P-013/82 marked Schedule “B” and described in Schedule “A”, both Schedules attached to and forming part of the report and recommendation,



Schedule “A”


All that certain area of land lying landward from the mean high watermark at Church Point Beach, situate at Church Point in the County of Digby, Province of Nova Scotia, as shown outlined in red on the copy of Crown Land Records Plan No. E-13-30 attached hereto, the said land being more particularly described as follows:


Beginning at a Survey Marker designated “A” on said Plan E-13-30, said Survey Marker also being (by grid bearings referred to the Nova Scotia 3° Modified Transverse Mercator Projection, zone 5, central meridian 64° 30' W longitude) S 16° 31' 28" E, a distance of 87.17 feet from Nova Scotia Coordinate Monument No. 26014;


Thence (from the place of beginning) S 25° 08' 26" E, a distance of 2295.28 feet to a point designated “B” on said Plan;


Thence S 07° 32' 58" E, a distance of 847.25 feet to a point designated “C” on said Plan;


Thence S 00° 11' 21" W, a distance of 1130.87 feet to a point designated “D” on said Plan;


Thence S 44° 34' 18" W, a distance of 510.66 feet to a point designated “E” on said Plan;


Thence S 29° 49' 17" E, a distance of 847.48 feet to a point designated “F” on said Plan;


Thence S 19° 08' 39" E, a distance of 603.48 feet to a point designated “G” on said Plan;


Thence S 00° 37' 57" E, a distance of 500.54 feet to a point designated “H” on said Plan;


Thence N 76° 31' 51" W, a distance of 35 feet to a Survey Marker designated “I” on said Plan, said Survey Marker also being N 27° 58' 15" W, a distance of 1239.62 feet from Nova Scotia Coordinate Monument No. 26012;


Thence continuing N 76° 31' 51" W, a distance of 22.02 feet to an Iron Bar designated “J” on said Plan; 


Thence continuing N 76° 31' 51" W, a distance of 18.74 feet to a stake designated H12 on said Plan;


Thence continuing N 76° 31' 51" W, a distance of 25 feet more or less to the mean high water mark of St. Mary’s Bay;


Thence in a northerly direction following the several courses of the mean high watermark of St. Mary’s Bay a distance of 6,750 feet more or less to a point;


Thence S 86° 25' 20" E, a distance of 23 feet more or less to a Survey Marker designated “K” on said Plan;


Thence continuing S 86° 25' 20" E, a distance of 45.50 feet to an iron bar designated “L” on said Plan;


Thence continuing S 86° 25' 20" E, a distance of 31.10 feet to the place of beginning.
