Shenacadie Beach Designation
made under subsection 5(1) of the
Beaches Act
R.S.N.S. 1989, c. 32
O.I.C. 78-852 (July 25, 1978), N.S. Reg. 160/78
The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 18th day of July, A.D., 1978, and pursuant to Section 5(1) of Chapter 6 of the Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act, is pleased to designate as a beach an area of land lying landward from the mean high water mark of Shenacadie Beach, in the County of Cape Breton, Province of Nova Scotia, as shown outlined in red on the copy of Crown Land Records Office Plan No. E-9-54 marked Schedule “B” and described in Schedule “A”, both schedules attached to and forming part of the report and recommendation.
Schedule “A”
All that certain lot, piece, parcel or tract of land situate lying and being adjacent to Shenacadie, in the County of Cape Breton, Province of Nova Scotia and designated as Shenacadie Beach as shown on a Plan of Survey filed in the Department of Lands and Forests Office at Halifax as Crown Land Records No. E-9-54, being more particularly described as follows:
Parcel “A”
Beginning at iron post No. 1 situate (by grid azimuths based on the Nova Scotia Three Degree Transverse Mercator Projection, Zone 4, central meridian sixty-one degrees thirty minutes west longitude) fifty-three degrees thirty-four minutes eight seconds, three thousand one hundred fifty-one decimal sixty-five feet from Nova Scotia Control Survey Monument No. 2321;
From thence two hundred thirty-eight degrees twenty-two minutes nine seconds, six hundred seventeen decimal zero seven feet to iron post No. 2;
Thence three hundred sixteen degrees fifty-four minutes twenty-four seconds, two hundred four decimal sixty-seven feet to iron post No. 3;
Thence two hundred eighty-two degrees nineteen minutes three seconds, five hundred sixty-nine decimal forty-one feet to iron post No. 4 situate on the mean high water mark of MacLean Pond;
Thence in a northerly and southeasterly direction, along the mean high water mark of MacLean Pond and the Bras d’Or Lakes, one thousand seven hundred thirty feet more or less to a point marked No. 5 on the aforementioned plan No. E-9-54;
Thence one hundred forty-eight degrees twenty-two minutes nine seconds, thirty six feet, more or less, to the place of beginning.
Parcel “B”
Beginning at point No. 6 as shown on the aforementioned plan No. E-9-54, said point being situate on the mean high water mark of the Bras d’Or Lakes two hundred ninety-five degrees nine minutes ten seconds, one thousand six hundred sixty-seven decimal ninety-four feet from iron post No. 1, said point also being three hundred thirty-nine degrees sixteen minutes eleven seconds, eight hundred fourteen decimal thirty-five feet from iron post No. 4;
From thence one hundred ninety-six degrees fifty minutes fourteen seconds, one hundred feet more or less to the mean high water mark of MacLean Pond;
Thence southerly and northerly along the mean high water mark of MacLean Pond and the Bras d’Or Lakes, one thousand one hundred eighty feet more or less to the place of beginning.
