Westhaver Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 92-729 (July 21, 1992), N.S. Reg. 155/92


The Governor in Council on the report and recommendation of the Minister of Natural Resources dated the 7th day of July, A.D., 1992, pursuant to Section 19(f) of Chapter 235 of the Revised Statutes of Nova Scotia, 1989, the Interpretation Act, and Section 5(1) of Chapter 32 of the Revised Statutes of Nova Scotia, 1989, the Beaches Act, is pleased to:

 

       (a)    rescind Order in Council 75-1188, dated the 21st day of October, A.D., 1975; and

 

       (b)    designate as a beach, an area of land lying landward from the mean high water mark of Westhaver Beach, in the County of Lunenburg, as described in Schedule “A”, and shown outlined in red on Schedule “B”, both Schedules attached to and forming part of the report and recommendation.



Schedule “A”


All that certain lot, piece or parcel of land situate, lying and being at Westhaver, in the County of Lunenburg, Province of Nova Scotia as shown on a Plan of Survey (Field Plot P-002/92) signed on the 4th day of February, A.D. 1992 by David L. Crooker, Nova Scotia Land Surveyor, and filed in the Department of Natural Resources Office, Dartmouth, the said parcel of land being more particularly described as follows:


Beginning at a survey marker (hereinafter being a set iron bar and aluminum cap) numbered L1990 situate (by grid bearings referenced to the Nova Scotia Three Degree Modified Transverse Mercator Projection, zone five, central meridian 64° 30' west longitude) N 71° 32' 58" E, a distance of 69.075 metres from Nova Scotia Coordinate Monument #16715 having coordinate values (Northing: 4921402.021 metres, Easting: 5512544.171 metres);


Thence (from the place of beginning) S 08° 05' 40"E, a distance of 41.428 metres to a stone retaining wall;


Thence S 36° 42' 06" E, following the said stone retaining wall a distance of 7.760 metres;


Thence S 12° 37' 14" E, following the said stone retaining wall a distance of 19.800 metres;


Thence S 04° 59' 46" W, following the said stone retaining wall a distance of 39.100 metres;


Thence S 55° 28' 14" W, a distance of 18.500 metres to a survey marker numbered L1991 situate on the eastern boundary of the public highway (Route 459), Maders Cove Road so-called;


Thence in a southeasterly direction following the eastern boundary of the public highway (Route 459) Maders Cove Road so-called to a survey marker numbered L1992 situate

N 39° 10' 14" W, a distance of 305.359 metres from Nova Scotia Coordinate Monument #16716 having coordinate values (Northing: 4920691.223 metres, Easting: 5513022.228 metres);


Thence N 66° 37' 29" E, a distance of 15.533 metres to the ordinary high water mark of Mahone Bay;


Thence in a northwesterly direction following the ordinary high water mark of the said Mahone Bay to a point situate N 24° 50' 24" W, a distance of 541.427 metres from the last mentioned point;


Thence S 76° 27' 08" W, a distance of 6.582 metres to the place of beginning.


The above described parcel of land contains 0.728 hectares more or less.
