Family Court Jurisdiction Regulations

made under subsection 7(3) of the

Family Court Act

Order in Council 71-1119 (November 2, 1971)

The Governor in Council on the report and recommendation of the Minister of Public Welfare dated the 28th day of October, 1971, pursuant to Section 3 of the Family Court Act, is pleased to confer on the Family Court for the Province of Nova Scotia, effective on and not before the 1st day of November, 1971, exclusive original jurisdiction over any or all charges, offences and matters arising from the following Acts or subjects:

 

                   (a)      the Wives’ and Children’s Maintenance Act;

 

                   (b)     the Maintenance Orders Enforcement Act;

 

                   (c)      the Children of Unmarried Parents Act;

 

                   (d)     the Employment of Children Act;

 

                   (e)      Parts III, IV, V, VI and VII of the Child Welfare Act;

 

                   (f)      the Juvenile Delinquents Act of Canada;

 

                   (g)     the Education Act, insofar as it relates to offences under Section 99 and failure to compel attendance of children at school;

 

                   (h)     Section 197 of the Criminal Code of Canada;

 

                   (i)      Section 245(1) of the Criminal Code of Canada where the parties involved are husband and wife or parent and child;

 

                   (j)      the Children’s Maintenance Act in actions between parent and child;

 

                   (k)     the Parents’ Maintenance Act in actions between parent and child;

 

                   (l)      Section 745 of the Criminal Code of Canada where the parties involved are husband and wife or parent and child.


Order in Council 73-1254 (November 20, 1973)

The Governor in Council on the report and recommendation of the Minister of Social Services dated the 1st day of November, 1973, and pursuant to subsection 1 of Section 3 of Chapter 98 of the Revised Statutes of Nova Scotia, 1967, the Family Court Act, as amended by Section 2 of Chapter 27 of the Statutes of Nova Scotia, 1968, and as further amended by Section 1 of Chapter 32 of the Statutes of Nova Scotia, 1972, and as further amended by Section 1 of Chapter 31 of the Statutes of Nova Scotia, 1973, is pleased to confer on the Family Court for the Province of Nova Scotia concurrent jurisdiction over any or all charges, offences and matters arising from Section 746 of the Criminal Code of Canada, where the parties are husband or wife or parent and child.


Order in Council 84-378, N.S. Reg. 67/1984

The Governor in Council on the report and recommendation of the Minister of Social Services dated the 28th day of March, 1984, and pursuant to clause (m) of subsection (1) of Section 3 of Chapter 98 of the Revised Statutes of Nova Scotia, 1967, the Family Court Act, is pleased to confer on the Family Court exclusive original jurisdiction over offences punishable on summary conviction pursuant to enactments of the Province and Municipal Bylaws and Ordinances including, without restricting the generality of the foregoing, the Motor Vehicle Act, Off Highway Motorized Vehicles Act, Snow Vehicles Act, Protection of Property Act, Liquor Control Act and Lands and Forest Act, by persons under the age of 16 years, effective 2nd day of April, 1984.


Order in Council 84-1496, N.S. Reg. 8/1985

The Governor in Council on the report and recommendation of the Attorney General dated the 19th day of December, 1984, and pursuant to Section 3(1)(j) of Chapter 98 of the Revised Statutes of Nova Scotia, 1967, as amended, the Family Court Act, is pleased to confer concurrent jurisdiction on the Family Court over any or all charges, offences and matters arising under Section 245(b) of the Criminal Code of Canada where the parties involved are husband or wife or parent and child.


Order in Council 98-135, N.S. Reg. 29/1998

The Governor in Council on the report and recommendation of the Minister of Justice dated February 3, 1998 pursuant to Section 7 of Chapter 159 of the Revised Statutes of Nova Scotia, 1989, the Family Court Act, is pleased to confer on the Family Court, in addition to that jurisdiction provided by clause 7(3)(c) of that Act, concurrent or general jurisdiction over any or all charges, offences and matters arising from Section 810 of the Criminal Code (Canada), where one of the parties is a child.


Order in Council 2020-362, N.S. Reg. 37/2020

The Governor in Council on the report and recommendation of the Attorney General and Minister of Justice dated December 10, 2019, and pursuant to clause 7(3)(d) of Chapter 159 of the Revised Statutes of Nova Scotia, 1989, the Family Court Act, is pleased to confer on the Family Court for the Province of Nova Scotia concurrent jurisdiction over all child and family services matters arising from Chapter 24 of the Statutes of Canada, 2019, An Act respecting First Nations, Inuit and Métis children, youth and families, effective on and after January 1, 2020.
