Health Authorities Act General Regulations
made under Section 78 of the
Health Authorities Act

Citation
1 These regulations may be cited as the Health Authorities Act General Regulations.
Definitions
2 (1) In these regulations,
“Act” means the Health Authorities Act, Chapter 32 of the Acts of 2014.
(2) In the Act,
“eligible to represent a bargaining unit”, with respect to a union that represents registered nurses or licensed practical nurses within the meaning of clause 89(1)(d) of the Act, means, in addition to meeting the criteria set out in that clause, that the union represents a majority of the total number of unionized registered nurses and unionized licensed practical nurses employed in the provincial health authority and the IWK Health Centre, combined, estimated as of November 25, 2014, and without consideration as to whether the union represents a majority of the total number of unionized registered nurses and unionized licensed practical nurses employed in the provincial health authority alone or the IWK Health Centre alone as of that date;
“provincial health authority” is further defined for the purposes of Section 59 of the Act to include the IWK Health Centre.

Provincial health authority name
3 The name of the provincial health authority is the Nova Scotia Health Authority.

Numbers of directors
5 (1) In accordance with subsection 52(1) of the Act, the number of voting directors for the board of the provincial health authority is 13.
(2) The Minister may select 1 member of the IWK Health Centre’s board to serve as an ex-officio, non-voting member of the provincial health authority’s board.
(3) The Minister may select 1 voting director of the provincial health authority’s board to serve as an ex-officio, non-voting member of the IWK Health Centre’s board.

Director’s term of office
6 A director of the provincial health authority may be appointed for a maximum term of 3 years, as specified in the director’s appointment in accordance with Section 54 of the Act.

Reimbursement of expenses
7 Director’s [Directors’] and community health board member’s [members’] expenses to be reimbursed under Sections 15 and 67 of the Act are reasonable expenses necessarily incurred in the carrying out of their duties related to dependant care, travel, meals, accommodations, long distance telephone calls, faxes, and photocopying.
