Power Engineers and Operators Appeal Committee : NS Labour and Advanced Education, Agencies & Boards

The Power Engineers and Operators Appeal Committee was created pursuant to the Crane Operators and Power Engineers Act which came into effect on September 1, 2001. It is an independent adjudicative tribunal charged with considering appeals filed under Part II of the Act.

The Inspector-Examiner, Power Engineers and Crane Operators Section of the Building, Fire and Technical Safety Division is responsible for ensuring compliance with Part II of the Act. Any person aggrieved by a decision of an inspector, including the Inspector-Examiner, may appeal, in writing, within 30 days to the Power Engineers and Operators Appeal Committee. The Power Engineers and Operators Appeal Committee may conduct a hearing orally or in writing. It has the power to:

  • refer a matter back to the Department for reconsideration with or without directions; or
  • make any decision that the Department could have made.

All decisions of the Power Engineers and Operators Appeal Committee are in writing and are supported by reasons. Decisions of the Committee are final.

Members

The Power Engineers and Operators Appeal Committee consists of three members: one professional engineer (mechanical), one power engineer and one owner or owner representative. The qualifications required by each Committee member are established in the Power Engineers Regulations
