Terms of Reference for Kaufman Review of PPS

Justice Minister Jim Smith today released the terms of reference for the independent review of the Public Prosecution Service (PPS). The review is being conducted by the Honourable Fred Kaufman, C.M., Q.C. and is expected to be completed by Dec. 31, 1998.

The review will assess the performance of the PPS and will consider prosecutorial independence and public accountability. It will examine the business elements of the service including resources, processes, structure and management. Mr. Kaufman will be asked to recommend appropriate means and mechanisms for accountability, independence, efficiency of operation and communication.

A management audit will also be conducted by independent consultants who will report directly to Mr. Kaufman. The audit will examine the organizational structure of the PPS in terms of economy, efficiency, and effectiveness in fulfilling its mandate. The management consultants will be hired in accordance with the procurement policy of the Province of Nova Scotia.

"The integrity Mr. Kaufman brings to this process will be a vital component in its success," said Mr. Smith. "We must take active steps to address the concerns Nova Scotians have expressed regarding the accountability and quality of service being provided by the Public Prosecution Service."

Mr. Kaufman said, "The terms of reference that have been developed provide the framework for a very thorough review of Nova Scotia's Public Prosecution Service. I look forward to working with the members of the PPS, and others involved in the criminal justice system."

Mr. Kaufman is a former judge of the Quebec Court of Appeal and sole commissioner on the proceedings involving Guy Paul Morin.
