Review Officer Reappointed, Given Five-Year Term

Darce Fardy will continue to keep an eye on how the province handles requests for information and protects the privacy of Nova Scotians.

Justice Minister Michael Baker has reappointed Mr. Fardy as the Review Officer for the Freedom of Information and Protection of Privacy Act for a five-year term. The appointment fulfills the government's commitment to appoint the review officer on a full- time basis.

"Open, accessible and accountable government is part of our commitment to Nova Scotians," said Mr. Baker. "This appointment recognizes the independence of the office and the fact that Mr. Fardy has brought integrity and fairness to the position over the past five years."

Mr. Fardy has carried out the functions of the Review Officer since 1995. Previously, he was appointed to one-year terms. He is responsible for conducting reviews of decisions, acts or failures to act by government as outlined in the legislation.

He is a former journalist, and network head of CBC-TV's current affairs department. His appointment is effective immediately, at a rate of $150 per day.

The appointment of Mr. Fardy to a five-year term is in keeping with amendments made in the last session of the legislature, which also extended the scope of the act to hospitals and municipalities. The Review Officer will now be provided with a separate budget vote and will be required to produce an annual report. In addition, he will be able to get a court order to obtain access to records, if necessary.

"We are very pleased that Mr. Fardy has agreed to stay on. I know he has earned respect and support from a broad base of sectors.
I am sure he will continue to serve Nova Scotians well," said Mr. Baker.
