Nova Scotia wants the federal government to take a stronger stand against home invasions. Justice Minister Michael Baker said the federal amendments to the Criminal Code identifying home invasions as an aggravating circumstance in robbery don't go far enough.

"It's a start, and it's an improvement, but I firmly believe a separate offence is necessary," said Mr. Baker. "This is weak-kneed response to a growing and critical problem."

Mr. Baker first raised the issue of a separate offence at a meeting last year of federal, provincial and territorial ministers. He said that a separate offence would give the court an opportunity to send clear sentencing messages. It would also provide an opportunity for communities to more effectively measure the impact -- and therefore deal with the problem -- of home invasions.

In April of this year, Mr. Baker released guidelines for Crown attorneys to use when dealing with home invasions. The guidelines provide a clear definition, reference relevant case law and outline sentencing recommendations. Provincial Crown attorneys have been able to secure the toughest sentences in the country with respect to home invasions, and the guidelines are designed to ensure this momentum continues.

"This simply isn't good enough, I will continue to push for action," said Mr. Baker. "The safety and security of Nova Scotians depends on it."
