Nunn Commission to Examine Youth Case

Justice D. Merlin Nunn of the Supreme Court of Nova Scotia has been appointed to lead the inquiry into the release from custody of a youth who was charged in the death of Theresa McEvoy of Halifax.

Justice Minister Michael Baker outlined the terms of reference for the Nunn Commission, today, June 29. The inquiry will examine how charges against the youth were handled in the days leading up to his release on Oct. 12, 2004 and circumstances surrounding the fatal collision two days later.

"This inquiry will consider the actions of law enforcement, the public prosecution service, government officials and the courts," said Mr. Baker." Mr. Nunn is highly respected and perfectly suited to chair this inquiry. I am confident that he will ensure that the inquiry process fully respects the integrity of any outstanding matters in the criminal justice process."

Mr. Baker says the process will be independent of government, and that Mr. Nunn will have the full co-operation of any government department or agency.

Mr. Nunn has authority under the Public Inquiries Act to hold public hearings and hear witnesses. The final report, including findings, conclusions and recommendations, will be made public.

"The terms of reference allow me to examine what happened, including the procedures and practices that were followed while these charges were handled," said Mr. Nunn. "My next step will be to establish an office and take care of preparatory matters that can be handled while the youth's case is addressed by the criminal courts."

Mr. Nunn was appointed to the trial division of the Supreme Court of Nova Scotia in 1982. He became a semi-retired justice in September 1997.
