Department Notifies Public of Mistaken Release

The Justice Department is notifying the public about a Halifax man who was mistakenly released Sept. 24 because of a clerical error.

Shane Captain Bernard Upshaw, 20, was convicted and awaiting sentencing for break, enter and theft, and firearm charges. He appeared in provincial court in Dartmouth on other matters Sept. 24 and was released.

Mr. Upshaw should have been returned to the Central Nova Scotia Correctional Facility in Burnside. There was an error on his documentation that indicated he need not return.

The mistake was discovered when the Kentville Crown called Central Nova to arrange a sentencing date. The department was notified late this afternoon.

Halifax Regional Police have been notified and are seeking Mr. Upshaw.

Anyone with information on his whereabouts is asked to call police.
