Decision for Reed, Marston, Vienneau, MacDonald and McKenna v. Province of Nova Scotia

Gail Gatchalian, chair of an independent board of inquiry in the matter of Warren Reed, Ben Marston, Paul Vienneau, Jeremy MacDonald and Kelly McKenna v. Province of Nova Scotia issued her decision late Thursday, Sept. 6.

In her decision, she found the province, Department of Environment, discriminated against members of the public who use wheelchairs by not regulating and enforcing provisions of the Food and Safety Regulations relating to having accessible washrooms in restaurants with summer patios.

Ms. Gatchalian ordered the province to interpret, administer and enforce the regulations as they appear. She also ordered that each complainant receive $1,000 in general damages.
