New Legislation Formalizes Class-action Suits in Nova Scotia

The province has introduced legislation to formally allow class-action lawsuits to be filed in Nova Scotia. Although class actions were technically possible, the new legislation clarifies rules and procedures surrounding these kinds of legal proceedings.

"Class proceedings have become more common in both Canada and the United States," said Justice Minister Cecil Clarke. "This legislation will benefit all parties by providing consistent rules in all cases."

The bill provides clear procedural rules for certifying a class proceeding, rules respecting discovery, admission of evidence, appeals and costs and fees.

"This important legislation supports the effective operation of our court system, and court users," said Mr. Clarke.
