Amendments to the Land Titles Clarification Act

The process for people adversely affected when a certificate of title is issued under the Land Titles Clarification Act would be simplified with legislation introduced today, April 30.

"There are complex and time-consuming procedures in the act to determine whether a person is detrimentally affected by an issued certificate of title," said Minister of Natural Resources Carolyn Bolivar-Getson. "We're amending the act to improve these procedures."

The amendment would allow for an independent investigation to determine if a person was adversely affected by the granting of a certificate of title to land by the minister of natural resources.

The new process shifts the investigation responsibility from the governor in council to the minister of natural resources, through an independent reviewer.

The bill proposes that when the independent reviewer determines a person has been adversely impacted, the minister of natural resources will recommend to the governor in council whether compensation should be paid to the applicant and, if so, the amount.
