Citation

1        These regulations may be cited as the Laboratory Services Fees Regulations.


Definitions

2        In these regulations,

 

“Department laboratory” means a laboratory operated by the Department, and includes all of the following:

 

                              (i)      analytic services laboratory,

 

                              (ii)     animal health services laboratory,

 

                              (iii)    dairy services laboratory;

 

“livestock animal” means any of the following:

 

                              (i)      cattle,

 

                              (ii)     sheep,

 

                              (iii)    goats,

 

                              (iv)    poultry,

 

                              (v)     rabbits raised for meat production,

 

                              (vi)    llamas,

 

                              (vii)   alpacas,

 

                              (viii)  fur-bearing animals from a fur farm licensed under the Fur Industry Act,

 

                              (ix)    deer farm animals from a deer farm licensed under the Wildlife Act,

 

                              (x)     wildlife from a game farm licensed under the Wildlife Act;

 

“regular hours of operation” means the period between 8:30 a.m. to 4:30 p.m., Monday to Friday, excluding holidays, during which the Department laboratory is open;

 

“related animals” means carcasses of livestock animals that

 

                              (i)      were of the same general age and exhibited the same disease symptoms, and

 

                              (ii)     are submitted for testing services by an owner on the same day.


Waiver of fees

3        The Minister may exempt a person from any provision of these regulations requiring payment for testing services.


Fees do not include applicable taxes

4        The fees prescribed in these regulations do not include any applicable taxes.

11      The following table sets out fees for administrative services by a Department laboratory:

Tests carried out immediately or outside regular hours

12      The fees for tests carried out, on request, either immediately or outside regular hours of operation are as follows:

 

                   (a)      for a test carried out immediately, but within the regular hours of operation, 2 times the fee set out in these regulations for the test;

 

                   (b)     for a test carried out outside the regular hours of operation, the fee set out in these regulations for the test, plus an additional fee of $126.00.


Fees for tests not listed

13      If a test is required that is not identified in these regulations, the fee for the test is based on the cost of labour and materials to perform the test.


Fees for registered farms

14      Despite Sections 6, 7, and 8, a fee payable under any of those Sections by a farm business or a farm operation that holds a valid farm registration number under the Farm Registration Act is 50% of the fee prescribed.


Fees for referred testing

15      (1)    The Department may refer testing to a laboratory not operated by the Department.

 

          (2)    The fee for testing that is carried out by a laboratory referred under subsection (1) is the sum of all of the following:

 

                   (a)      the actual cost of the test;

 

                   (b)     a handling fee of $4.00;

 

                   (c)      shipping costs.
