Bayfield Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 76-969 (August 17, 1976), N.S. Reg. 138/76


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 15th day of July, A. D., 1976, pursuant to the Beaches Preservation and Protection Act, Statutes of Nova Scotia, 1975, Chapter 6, Section 5(1), is pleased to designate as a beach an area of land lying landward from the mean high water mark of Bayfield Beach, in the County of Antigonish, Province of Nova Scotia, as shown outlined in red on the copies of Crown Land Records Office Plan No. E-7-69, marked Schedule “B” and Crown Land Records Office Plan No. E-10-60 marked Schedule “C”, and described in Schedule “A” all attached to and forming part of the report and recommendation.



Schedule “A”

First Lot

All that certain area of land lying landward from the mean high water mark of Bayfield Beach, in the County of Antigonish, Province of Nova Scotia as shown outlined in red on a copy of Plan No. E-7-69, attached hereto and marked Schedule “B”, filed in the Crown Land Records Office, Halifax and being more particularly described as follows:


Beginning at an Iron Post No. 3 set at the intersection of the northern boundary of the highway leading from Bayfield to Tracadie and the boundary line between lands now or formerly of Eugene Connors and lands now or formerly of A. Randall;


From thence northerly along the northerly boundary of said highway to Iron Post No. 4 situate north forty-four degrees five minutes west (by astronomic bearings based on observations on Polaris at Station Iron Post No. 2 of this survey) two thousand fourteen decimal thirty-three feet from Iron Post No. 3;


Thence westerly along the northerly boundary of said highway to Iron Post No. 5 situate north eighty degrees eleven minutes west one thousand two hundred twenty-six decimal forty-nine feet from Iron Post No. 4;


Thence continuing westerly along the northerly boundary of said highway to Iron Post No. 6 situate south eighty-six degrees thirty-four minutes west one thousand eight hundred fifty-one decimal seventy-four feet from Iron Post No. 5;


Thence continuing westerly along the northerly boundary of said highway to Iron Post No. 7 situate north sixty-six degrees fifty-three minutes west one thousand nine hundred forty-one

decimal eighty-four feet from Iron Post No. 6, said Iron Post No. 7 set at the intersection of the northerly boundary of the highway leading from Bayfield to Tracadie and the westerly boundary of the road leading to Pomquet Point;


Thence along the westerly boundary of said road leading to Pomquet Point to Iron Post No. 17 set by the Department of Transport and being north fifteen degrees four minutes east four thousand six hundred forty decimal thirty-nine feet from Iron Post No. 7;

Thence north one degree forty-nine minutes east one thousand one hundred thirty-six decimal zero two feet to Iron Post No. 8 set on top of the bank of Pomquet Point;


Thence continuing north one degree forty-nine minutes east fourteen hundred feet to a point situate in the waters of George Bay;


Thence south forty-seven degrees forty-two minutes thirty-three seconds east four thousand nine hundred seventy-five decimal twenty feet to a point situate in the waters of George Bay;


Thence south eighteen degrees ten minutes east four thousand six hundred feet to Iron Post No. 1 set eighty-four feet more or less from the mean high water mark at the top of the bank beside an old road, and situate north forty-seven degrees fifty-six minutes east forty-eight decimal thirty feet from the northeast corner of Chisholm cottage;


Thence continuing south eighteen degrees ten minutes east one thousand eight hundred forty-seven decimal twenty-five feet to Iron Post No. 2 set at the edge of a brook and fifty

feet from the centre line of the beforementioned highway leading from Bayfield to Tracadie;


Thence north seventy-eight degrees fourteen minutes west seven hundred thirty-eight decimal seventeen feet to the place of beginning.


Excepting and reserving from the above described area of land all the portion thereof lying seaward from the mean high water mark.


Second Lot

All that certain area of land lying landward from the mean high water mark of Bayfield Beach, in the County of Antigonish, Province of Nova Scotia, as shown outlined in red on a copy of Plan No. E-10-60, attached hereto and marked Schedule “C”, filed in the Crown Land Records Office, Halifax, and being more particularly described as follows:


Beginning at beforementioned Iron Post No. 8 situate on the westerly boundary of the “First Lot” herein described;


From thence northerly to a point situate on the mean high water mark of George Bay and shown as Point “B” on said Plan No. E-l0-60;


Thence southwesterly, northerly and southerly following the various courses of the mean high water mark of George Bay to a point situate at the intersection of the northern boundary of lands now or formerly of Donald Chisholm and the mean high water mark of George Bay;


Thence southeasterly to a point situate two hundred fifty feet landward and perpendicular to the mean high water mark of George Bay and shown as Point “D” on said Plan No. E-10-60;


Thence northerly and northeasterly following the various courses of a line two hundred fifty feet landward and perpendicular to the mean high water mark of George Bay to a point shown as Point “A” on said Plan No. E-10-60;


Thence northerly to the place of beginning.
