Cherry Hill Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 94-170 (March 1, 1994), N.S. Reg. 36/94


The Governor in Council on the report and recommendation of the Acting Minister of Natural Resources dated the 3rd day of February, A.D., 1994, pursuant to Section 5(1) of Chapter 32 of the Revised Statutes of Nova Scotia, 1989, the Beaches Act, is pleased to determine as a beach, an area of land, lying landward from the mean high watermark of Cherry Hill Beach, in the County of Lunenburg, as described in Schedule “A” and shown outlined in bold line on the copy of Provincial Crown Lands Record Centre Plan No. E-15-44 marked Schedule “B”, both Schedules attached to and forming part of the report and recommendation.



Schedule “A”


All that certain lot, piece or parcel of land situate, lying and being at Cherry Hill Beach, Cherry Hill, in the County of Lunenburg, Province of Nova Scotia, shown on a compiled plan having C.L.R. No. E-15-94 (Field Plot No. P-040/85A-1) dated April 23, 1993, and filed in the Crown Lands Record Centre, Dartmouth, the said parcel of land being more particularly described as follows:


Beginning at the intersection of the mean high watermark of Hell Bay and the western boundary of the land now or formerly of George Conrad;


Thence northeasterly a distance of 50 feet more or less to a point;


Thence N 43° 00' 02" E, a distance of 317.71 feet to a point;


Thence N 44° 27' 37" W, a distance of 675.35 feet to a point. Said point being at the mean high watermark of Point Medway Harbour;


Thence along the mean high watermark of Port Medway Harbour northwesterly 1460 feet more or less to a point being 3 feet from survey marker L916. Said survey marker L916 being S 88° 48' 02" W, a distance of 1,201.34 feet from last mentioned point;


Thence continuing along the mean high watermark of Port Medway harbour southwesterly 5920 feet more or less to survey marker L913. Said survey marker being S 52° 18' 56" W, a distance of 5,066.43 feet from last mentioned survey marker L916;


Thence continuing along the mean high water mark a distance of 1,870 feet more or less to survey marker L914;


Thence continuing along the mean high water mark of Hell Bay 5,390 feet more or less to a point being 9 feet from survey marker L915. Said survey marker being N 41° 40' 53" E, a distance of 5,192.74 feet from the last mentioned survey marker L914;


Thence continuing along the mean high watermark of Hell Bay, a distance of 1,050 feet more or less to the point of beginning.


The above described lot contains an area of 90 acres more or less.


Saving and excepting the 66 foot wide public road known as Bound Road situate at the eastern end of Cherry Hill Beach and being more particularly described as follows:


Beginning at the intersection of the eastern limit of Cherry Hill Beach and the northwestern boundary of said public road;


Thence southwesterly along the northwestern boundary of Bound Road, an arc distance of 91 feet more or less to a point;


Thence continuing along the northwestern boundary of Bound Road S 08° 11' 55" W, a distance of 50.00 feet to a point. Said point being on a curve the right having a radius of 100.00 feet;


Thence along the said curve an arc distance of 95.99 feet to a point. Said point being S 35° 41' 55" W, a distance of 92.35 feet from the last mentioned point;


Thence along a curve to the left having a radius of 295.93 feet, an arc distance of 105.48 feet to a point. Said point being S 52° 59' 13" W, a distance of 104.93 feet from last mentioned point. Said point also being at the end of maintained portion of public road and 45 feet more or less from the mean high watermark of Hell Bay;


Thence along the end of the maintained portion of the public road S 47° 13' 07" E, a distance of 66.00 feet to a point. Said point being on the southeastern boundary of aforementioned road. Said point also being 20 feet more or less from the mean high watermark of Hell Bay.


Thence along a curve to the right, an arc distance of 81.96 feet to a point. Said point being N 52° 59' 13" E, a distance of 81.52 feet from the last mentioned point;


Thence along a curve to the left, an arc distance of 159.35 feet to a point. Said point being N 35° 41' 55" E, a distance of 153.30 feet from the last mentioned point;


Thence N 08° 11' 55" E, a distance of 50.00 feet to a point;


Thence along a curve to the right, an arc distance of 48 feet to a point. Said point being on the intersection of the southeastern boundary of the aforementioned Bound Road and the eastern limit of the Cherry Hill Beach.


Thence along the eastern limit of the Cherry Hill Beach N 44° 27' 34" W, a distance of 67.6 feet more or less to the point of beginning.
