Fancy’s Beach Designation
made under subsection 5(1) of the
Beaches Act
R.S.N.S. 1989, c. 32
O.I.C. 77-122 (February 8, 1977), N.S. Reg. 18/77
The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 14th day of January, A.D., 1977, pursuant to Section 5(1) of Chapter 6 of the Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act, is pleased to designate as a beach an area of land lying landward from the mean high watermark of Fancy’s Beach, situate at Marie Joseph, in the County of Guysborough, Province of Nova Scotia, as shown outlined in red on the copy of Crown Land Records Office Plan No. E-7-85, marked Schedule “B”, and described in Schedule “A”, both attached to and forming part of the report and recommendation.
Schedule “A”
All that certain area of land lying landward from the mean high watermark of Fancy’s Beach, situate at Marie Joseph, in the County of Guysborough, Province of Nova Scotia as shown outlined in red on the copy of Crown Land Records Office Plan No. E-7-85, attached hereto and being more particularly described as follows:
Beginning at iron post #1 as shown on said Plan E-7-85, said iron post being situated on the west side of the public road leading to Fancy’s Beach and being on a grid bearing of north eighty-two degrees nineteen minutes thirty-two seconds east eight thousand two hundred eighty-one decimal forty-three feet from Nova Scotia Control Monument 11709, said control monument having grid co-ordinates (N 16, 341, 422.26, E 848, 840.02) based on the Nova Scotia 3° Transverse Mercator Projection, Zone 4, Central Meridian 61° 30' West Longitude;
From thence (by grid bearings) north thirty-four degrees two minutes thirty-two seconds east eight hundred decimal zero feet to a point;
Thence north sixty-seven degrees five minutes twenty-one seconds east eight hundred thirty-eight decimal sixty feet to iron post #2 situated approximately on the line of vegetation and being north seventy-six degrees, zero minutes thirty-two seconds east two thousand one hundred fifty-nine decimal seventy-six feet from Nova Scotia Control Monument 11708, said control monument having grid co-ordinates (N 16, 342, 995.27, E 856, 171.36);
Thence easterly and southeasterly along the line of vegetation to iron post #3, said iron post being south seventy-seven degrees nineteen minutes forty-eight seconds east one thousand three hundred eighty-three decimal thirty-seven feet from aforementioned iron post #2 and being situate south forty-seven degrees forty-one minutes thirty-one seconds east two hundred forty-seven decimal thirty-one feet from Crown Land iron post #7659;
Thence south forty-seven degrees forty-one minutes thirty-one seconds east one thousand decimal zero feet to a point situated under the tidal waters of the Atlantic Ocean;
Thence south forty-two degrees eighteen minutes twenty-nine seconds west four thousand decimal zero feet to a point situated under the tidal waters of the Atlantic Ocean;
Thence north fifty-eight degrees forty-six minutes thirty-six seconds west one thousand one hundred eighty-three decimal zero three feet to iron post #4;
Thence north ten degrees seventeen minutes fifty-six seconds west one thousand four hundred decimal zero feet to a point situated under the tidal waters of Smith Cove;
Thence north thirty-four degrees two minutes thirty-two seconds east one thousand one hundred fifty-two decimal zero six feet to the place of beginning.
Excepting and reserving from the above described area of land all the portion thereof lying seaward from the mean high watermark.
