Gabarus Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 76-1316 (November 4, 1976), N.S. Reg. 153/76


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 12th day of October, A.D., 1976, pursuant to Section 5(1) of Chapter 6 of the Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act, is pleased to designate as a beach an area of land lying landward from the mean high watermark of Gabarus Beach, situate at Gabarus Barachois, in the County of Cape Breton, Province of Nova Scotia, as shown outlined in red on the copy of Crown Land Records Office Plan No. E-7-78, marked Schedule “B”, and described in Schedule “A”, both attached to and forming part of the report and recommendation.



Schedule “A”


All that certain area of land lying landward from the mean high watermark of Gabarus Beach situate at Gabarus Barachois, in the County of Cape Breton, Province of Nova Scotia as shown outlined in red on the copy of Crown Land Records Office Plan No. E-7-78, attached hereto and being more particularly described as follows:


Beginning at Crown Land Iron Post No. CB2376 situate south fifty-five degrees fifteen minutes zero seconds east, a distance of two thousand nine hundred twenty-eight decimal zero nine seven feet from Nova Scotia Control Survey Monument No. 2077;


From thence (by magnetic bearings of the year 1970) north eighty-nine degrees thirty-four minutes zero seconds west, a distance of four hundred thirty-six decimal forty-eight feet to Crown Land Iron Post No. CB2385;


Thence south thirty-three degrees seven minutes ten seconds west, a distance of seven hundred forty-seven decimal fifty-eight feet to Crown Land Iron Post No. CB2384;


Thence south sixteen degrees twelve minutes forty-five seconds west, a distance of six hundred thirty-eight decimal ninety-two feet to Crown Land Iron Post No. CB 2383;


Thence south zero degrees twenty-eight minutes forty seconds east, a distance of four hundred four decimal ninety-seven feet to Crown Land Iron Post No. CB2382;


Thence south twenty-nine degrees forty-six minutes twenty-five seconds west, a distance of two hundred forty-five decimal ninety-one feet to Crown Land Iron Post No. CB2381;


Thence south nine degrees fifty minutes twenty seconds west, a distance of eight hundred nineteen decimal zero two feet to Crown Land Iron Post No. CB2380;


Thence south zero degrees thirty-nine minutes zero seconds east, a distance of two hundred thirty decimal seventy-five feet to Crown Land Iron Post No. CB2379;


Thence south thirty-nine degrees forty-eight minutes twenty seconds east, a distance of six hundred two decimal zero one feet to Crown Land Iron Post No. CB2378;


Thence south eighty-nine degrees twenty-one minutes thirty-five seconds east, a distance of three hundred eighty-six decimal thirty-one feet to Crown Land Iron Post No. CB2377;


Thence north eight degrees thirty-five minutes forty-five seconds east, a distance of three thousand three hundred ninety-eight decimal sixty-nine feet to the place of beginning.


Excepting and reserving from the above described area of land all the portion thereof lying seaward from the mean high watermark.
