Juries Regulations

made under Section 27 of the

Juries Act

S.N.S. 1998, c. 16

O.I.C. 2000-356 (June 29, 2000), N.S. Reg. 126/2000

as amended to O.I.C. 2015-277 (August 21, 2015), N.S. Reg. 308/2015


Citation

1     These regulations may be cited as the Juries Regulations.


Section 2 repealed: O.I.C. 2015-277, N.S. Reg. 308/2015.


Disqualified person

3     A person who

 

(a)    is attending law school;

 

(b)    has attended law school; or

 

(c)    is exempt under Section 268 of the National Defence Act (Canada)

 

is disqualified from serving on any jury.


Prescribed list

4     The Department of Health’s Health Insurance list is a prescribed list pursuant to Section 8 of the Act.

[Note: Effective January 11, 2011, the reference to the Department of Health should be read as a reference to the Department of Health and Wellness in accordance with Order in Council 2011-15 under the Public Service Act, R.S.N.S. 1989, c. 376.]


Fees

5     Despite the Costs and Fees Act,

 

                (a)    if the person’s place of residence is in excess of 100 km from the place of attendance, the travel allowance for a person summoned for jury duty shall be $0.20/km for both ways between the place of attendance and the residence of the person within the jury district;

 

                (b)    the travel allowance for a juror shall be $0.20/km for both ways between the place of attendance and the residence of the juror within the jury district;

 

                (c)    the fee to be paid to a juror for attendance at a trial by the juror shall be $40 per day.
