TRANSPORTATION/PUBLIC WORKS--HIGHWAY 104 AGREEMENTS FOR RELEASE ----------------------------------------------------------------- The Department of Transportation and Public Works has received clearance to release the annual roadway maintenance and interim work agreements for the new Highway 104 Western Alignment. These agreements involved the province, the Highway 104 Corporation and Atlantic Highways Corporation (AHC), the consortium building the new alignment. These two agreements were among three contracts that were the subject of an application under the Freedom of Information and Protection of Privacy Act. Atlantic Highways Corporation had objected to the department's decision to release these contracts, and a third contract, the omnibus agreement. In a letter to the department, AHC writes that it does not object to the release of the first two agreements, but maintains its objection to the release of the omnibus agreement. A hearing is scheduled for Feb. 26, at the Supreme Court of Nova Scotia to determine whether that document should be made public. "Our position has always been to release the omnibus agreement, the annual maintenance agreement and the interim work agreement," said Transportation and Public Works Minister Don Downe.
