Westphal Healthcare Facility Area Order
made under Section 229C of the
Halifax Regional Municipality Charter

Schedule “A” Westphal Healthcare Facility Area
Schedule “B” Location of Westphal Healthcare Facility (Lot A)
Whereas healthcare facilities in the Halifax Regional Municipality are urgently required for the purpose of meeting the healthcare needs of the residents of the Province;
And whereas a healthcare facility has been proposed near Old Miller Road and Main Street, Westphal, which will be developed faster and more efficiently with the designation of a healthcare facility area;
Therefore, I order the following:
1. A proposed healthcare facility is urgently required for the purpose of Section 229C of the Halifax Regional Municipality Charter.
2. The area of the Halifax Regional Municipality located at Old Miller Road and Main Street, Westphal, identified by Parcel Identification Number 40150567, is designated as a healthcare facility area.
3. The healthcare facility area may be referred to as the “Westphal Healthcare Facility Area.”
4. The Westphal Healthcare Facility Area is designated for the purpose of building and operating a healthcare facility, which must be substantially consistent with the drawings, plans and details attached as Schedule “A” to this order.
5. The land within the Westphal Healthcare Facility Area shall be subdivided as indicated in the attached Schedule “B.” The land parcel identified by Parcel Identification Number 40150567 shall be subdivided to create “lot A” as indicated in Schedule “B” and the healthcare facility must be located in the parcel of land identified as “lot A.”
6. Halifax Regional Municipality Bylaw G-200, the Grade Alteration Bylaw, does not apply to the land identified as “lot A,” for the purposes of the development of the healthcare facility.
7. Any municipal planning strategies, land-use bylaws, development agreements, policies and subdivision bylaws in force in the Halifax Regional Municipality do not apply to the land identified as “lot A.”
8. Any municipal planning strategies, land-use bylaws, development agreements, policies and subdivision bylaws in force in the Halifax Regional Municipality apply to the remaining lands identified as “Parcel HCC1-R (remaining lands)” in Schedule “B.”
This Order is effective on and after the date it is filed with the Registrar of Regulations.
