Fox Harbour Provincial Park Designation

made under Section 8 of the

Provincial Parks Act

R.S.N.S. 1989, c. 367

O.I.C. 90-1366 (November 20, 1990), N.S. Reg. 305/90


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 30th day of October, A.D., 1990, pursuant to Section 8 of Chapter 367 of the Revised Statutes of Nova Scotia, 1989, the Provincial Parks Act, is pleased to:

 

                (a)    designate all that area of land situate at North Wallace Point, in the County of Cumberland, owned by Her Majesty the Queen in right of the Province of Nova Scotia, to be a Provincial Park, the said area of land being described in Schedule “A” and shown outlined in bold line on the copy of Provincial Crown Lands Record Centre Plan No. E-15-28 marked Schedule “B”, both Schedules attached to and forming part of the report and recommendation; and

 

                (b)    declare that the Park shall be known by the name of “Fox Harbour Provincial Park”.



Schedule “A”


All and singular those certain lots, pieces, or parcels of land situate, lying, and being at North Wallace Point, in the County of Cumberland, Province of Nova Scotia and shown outlined in red as Parcel A and Parcel B on a compiled plan showing Fox Harbour Provincial Park, North Wallace Point, Cumberland County, Nova Scotia, and filed in the Crown Land Records Centre, Dartmouth, Nova Scotia (C.L.R. No. E-15-28) and being more particularly described as follows:


Parcel A

Beginning at SM C2343 situate on the northern boundary of the main public highway leading from Fox Harbour to North Wallace and the eastern boundary of lands now or formerly of Edward Greer;


Thence along the eastern boundary of lands now or formerly of Edward Greer 06° 44' 25", a distance of 632.25 feet to SM C2344;


Thence continuing along the eastern boundary of lands now or formerly of Edward Greer, 06° 44' 25", a distance of 10 feet to the ordinary high was [water] mark of Fox Harbour;


Thence easterly along the ordinary high water mark of Fox Harbour, a distance of 6700 feet more or less to a point. Said point being on the northern boundary of lands now or formerly of David Elliott;


Thence along the northern boundary of lands now or formerly of David Elliott, 271° 58' 55", a distance of 21 feet to SM C2345;


Thence continuing along the northern boundary of lands now or formerly of David Elliott, 271° 58' 55", a distance of 702.87 feet to SM C2346. Said survey marker being on the eastern boundary of lands now or formerly of Gerald Thompson;


Thence along the eastern boundary of lands now or formerly of Gerald Thompson, 08° 30' 49", a distance of 416.23 feet to SM C2347;


Thence along the northern boundary of lands now or formerly of Gerald Thompson, 269° 52' 54", a distance of 730.79 feet to SM C2348. Said survey marker being on the northern boundary of lands now or formerly of Gerald Thompson and the eastern boundary of the aforementioned main public highway leading from Fox Harbour to North Wallace;


Thence along a curve to the left having a radius of 527.49 feet, an arc distance of 747.88 feet to SM C2358. Said survey marker being 320° 39' 57", a distance of 686.80 feet from last mentioned SM C2348;


Thence 280° 02' 56", a distance of 751.79 feet to SM C2355;


Thence along a curve to the left having a radius of 1960.11 feet, an arc distance of 253.73 feet to SM C2354. Said SM C2354 being 276° 20'34", a distance of 253.54 feet from last mentioned SM C2355;


Thence continuing along the northern boundary of the aforementioned main public highway leading from Fox Harbour to North Wallace, 272° 37' 57", a distance of 1476.21 feet to the point of beginning.


Parcel B

Beginning at SM C2349 situate on the western boundary of the main public highway leading from Fox Harbour to North Wallace, and the northern boundary of lands now or formerly of David Elliott;


Thence along the northern boundary of lands now or formerly of David Elliott, 272° 23' 12", a distance of 587.36 feet to SM C2350;


Thence 04° 51' 48", a distance of 590.24 feet to SM C2351;


Thence 272° 48' 32", a distance of 698.88 feet to SM C2352 situate on the eastern boundary of lands now or formerly of William Burton;


Thence along the eastern boundary of lands now or formerly of William Burton, 05° 23' 38", a distance of 342.81 feet to C2353. Said SM C2353 being on the southern boundary of the main public highway leading from Fox Harbour to North Wallace;


Thence along a curve to the right having a radius of 1860.11 feet, an arc distance 136.31 feet to SM C2356. Said SM C2356 being 97° 57' 02", a distance of 136.28 feet from the last mentioned SM C2353;


Thence 100° 02' 56", a distance of 751.79 feet to SM C2357;


Thence along a curve to the right having a radius of 427.49 feet an arc distance of 623.62 feet to SM C2359. Said SM C2359 being 141° 50' 30", a distance of 569.78 feet from the last mentioned SM C2357;


Thence 183° 36' 50", a distance of 390.90 feet to the place of beginning.


Parcel A and Parcel B have a total combined area of 75.3 acres more or less.
