Whycocomagh Provincial Park Designation

made under Section 8 of the

Provincial Parks Act

R.S.N.S. 1989, c. 367

O.I.C. 72-89 (January 25, 1972), N.S. Reg. 131/72


The Governor in Council on the report and recommendation of the Minister of Lands and Forests dated the 17th day of January, A.D., 1972, pursuant to Section 2 of Chapter 244 of the Revised Statutes of Nova Scotia, 1967, the Provincial Parks Act, is pleased to:

 

                (a)    constitute all that area of land including land covered with water owned by Her Majesty in right of the Province of Nova Scotia, and situate at Whycocomagh in the County of Inverness, Province of Nova Scotia, to be a provincial park, said land being more particularly described in Schedule “A” and shown on the plan of survey marked Schedule “B”, both attached to the report and recommendation; and

 

                (b)    declare the name by which the park shall be known as “Whycocomagh Provincial Park.”

All that certain lot, piece or parcel of land situate at Whycocomagh, County of Inverness, Province of Nova Scotia, shown as Lot “A”, Lot “B”, Lot “C”, Lot “D” and Lot “E” on Plan #E-8-28 recorded in the Crown Land Records Office, Department of Lands and Forests, Halifax, and being more particularly described as follows:


Lot “A”

Beginning at Crown Land post number 188 situated on the easterly boundary of Victoria Line Road so-called;


Thence (by magnetic bearings 1958) north seventy-four degrees forty-five minutes east, one hundred eighty-one decimal five feet to Crown Land post number 187;


Thence north fourteen degrees thirty minutes west, three hundred thirty-one decimal ninety-eight feet to Crown Land post number 186;


Thence north seventy-nine degrees thirty minutes east, one thousand three hundred seventy decimal eighty-two feet to Crown Land post number 185;


Thence (by magnetic bearings 1960) due east, one thousand four hundred seventy-six decimal forty-two feet to Crown Land post 185A;


Thence north three degrees fifteen minutes east, five hundred forty decimal fifty-four feet to Crown Land post number 185B;


Thence south eighty-nine degrees fifteen minutes east, one thousand six hundred fifty feet to Crown Land post number 185C;

 

Thence south three degrees fifteen minutes west, one thousand three hundred twenty-six decimal six feet to Crown Land post number 185D;


Thence north eighty-nine degrees fifteen minutes west, seven hundred seventy-eight decimal fourteen feet to Crown Land post number 185E;


Thence south three degrees fifteen minutes west, three hundred nineteen decimal forty-four feet to Crown Land post #169;


Thence (by magnetic bearing 1958) south two degrees thirteen minutes west, two thousand three hundred fifty-two decimal nine feet to Crown Land post number 170;


Thence continuing south two degrees thirteen minutes west to point “A” being on the northern boundary of the Trans Canada Highway;


Thence westerly along the northern boundary of the Trans Canada Highway to Point “B” being the south eastern corner of a lot of privately owned lands;


Thence (by magnetic bearing 1958) north five degrees fifty minutes east, to Crown Land post number 176;


Thence north seventy-three degrees zero minutes west, to Point “C” being on the northerly boundary of the Trans Canada Highway;


Thence westerly along the northerly boundary of the Trans Canada Highway to Point “D” being the intersection of the northerly boundary of said highway with the easterly boundary of Victoria Line Road so-called;


Thence northerly and westerly along the easterly boundary of Victoria Line Road to the place of beginning containing three hundred thirty-one acres more or less;


Excepting and reserving therefrom any grants of easements of right-of-way in connection with power transmission lines or any other public utility over the above described lands;


Lot “B”

Beginning at point “J” being the intersection of the westerly boundary of Victoria Line Road so-called, and the northerly boundary of the Trans Canada Highway;


Thence northwesterly along the northerly boundary of the Trans Canada Highway to point “K” being the intersection of the northerly boundary of said highway with the easterly boundary of lands now or formerly of John W. MacQueen;


Thence northerly along the easterly boundary of the MacQueen lands to point “L” being an angle in the said easterly boundary of the MacQueen lands;


Thence easterly and continuing along the MacQueen lands to Point “M” said point being on the westerly boundary of Victoria Line Road;


Thence southerly along the westerly boundary of Victoria Line Road to the place of beginning containing eight acres more or less;

 

Lot “C”

Beginning at Grown Land post number 20 said post being situated on the westerly boundary of Victoria Line Road so-called and said post also marking the most northeasterly corner of lands now or formerly of John L. MacQueen;


Thence (by magnetic bearing 1955) south eighty degrees zero minutes west, one hundred thirty-three decimal ninety-eight feet to Crown Land post number nineteen;


Thence (by magnetic bearing 1958) south seventy-nine degrees fifteen minutes west, five hundred twenty-four decimal zero six feet to Crown Land Post number 18B;


Thence south twelve degrees twenty minutes east, eighty-eight decimal forty-four feet to Crown Land post number 18A;


Thence south seventy-six degrees thirty minutes west, one hundred decimal ninety-eight feet to Crown Land post number 17A said post being situated on the easterly boundary of the Trans Canada Highway;


Thence northerly along the easterly boundary of the Trans Canada Highway to point “N” said point being the intersection of the easterly boundary of said highway with the westerly boundary of Victoria Line Road;


Thence southerly along the westerly boundary of Victoria Line Road to the place of beginning containing five acres more or less;


Lot “D”

Beginning at point “S” said point being situated where the mean high water line of Whycocomagh Bay intersects with the most southwesterly boundary of the Trans Canada Highway;


Thence northeasterly and northwesterly along the said most southwesterly boundary of the Trans Canada Highway to Crown Land post number 11A;


Thence (by magnetic bearing 1958) north eighty-one degrees zero minutes west, three hundred seventy-six decimal eighty-six feet to Crown Land post number 14A;


Thence north seven degrees fifty-five minutes east, six hundred sixty-four decimal sixty-two feet to Crown Land post number 14B said post being on the westerly boundary of the Trans Canada Highway;


Thence northerly along the westerly boundary of the Trans Canada Highway to point “P”;


Thence (by magnetic bearing 1959) south seventy-nine degrees fifteen minutes west to Crown Land post number 21A;


Thence south eighty-three degrees thirty minutes west, three hundred ninety-six decimal zero feet to Crown Land post number 10A;


Thence continuing south eighty-three degrees thirty minutes west to point “V’” situated on the mean high water line of Whycocomagh Bay;


Thence continuing south eighty-three degrees thirty minutes west, eight hundred feet to point “U” situated on Whycocomagh Bay;


Thence in a southeasterly direction on Whycocomagh Bay and maintaining a distance of eight hundred feet from the mean high water line of said Bay to Point “T”;


Thence in a direct line eight hundred feet to the place of beginning containing thirty-two acres more or less and not including any lands covered by the waters of Whycocomagh Bay;


Lot “E”

Beginning at point “E” situated on the southerly boundary of the Trans Canada Highway, said point being on a prolongation of the aforementioned line from Crown Land post number 170 to point “A”, as described in Lot “A”;


Thence (by magnetic bearing 1958) south two degrees thirteen minutes west to point “F” situated on the mean high water mark of Whycocomagh Bay;


Thence continuing south two degrees thirteen minutes west, eight hundred feet to point “Q” situated on Whycocomagh Bay;


Thence westerly on Whycocomagh Bay and maintaining a distance of eight hundred feet from the mean high water line of said Bay to point “W” said point being on a prolongation of the line from Crown Land post number 176 to point “B” previously described in Lot “A”;


Thence north five degrees fifty-minutes east, eight hundred feet to point “G” situated on the mean high water line of Whycocomagh Bay;


Thence continuing north five degrees fifty minutes east to point “H” situated on the southerly boundary of the Trans Canada Highway;


Thence easterly along the southerly boundary of the Trans Canada Highway to the place cf beginning containing one acre more or less and not including any land covered by the waters of Whycocomagh Bay.
