Citation

1        These regulations may be cited as the Order Criteria and Factors Regulations.


Definitions

2        In these regulations,

 

“Act” means the Housing in the Halifax Regional Municipality Act;

 

“Board” means the Nova Scotia Regulatory and Appeals Board;

 

“order” means an order that the Minister may issue to the Municipality or a utility owned by the Municipality under Section 21A of the Act.


Criteria and factors for issuing orders

3        Before issuing an order, the Minister must consider all of the following:

 

                   (a)      relevant and available data and information respecting water resources and wastewater and stormwater capacity;

 

                   (b)     public health and safety;

 

                   (c)      existing municipal and utility capital planning, and the condition of assets and infrastructure;

 

                   (d)     the potential impact to provincial, municipal and utility budgets, finances, and human resources;

 

                   (e)      the potential impact to rates, fees and charges;

 

                   (f)      any existing or potential funding sources or funding agreements;

 

                   (g)     any potential compliance issues with respect to federal or provincial legislation or Board orders and decisions;

 

                   (h)     any relevant information provided by the Municipality or the utility owned by the Municipality;

 

                   (i)      whether discussions with the Municipality and the utility owned by the Municipality to identify mutually beneficial solutions have occurred.
